HomeMy WebLinkAboutRESO 4006pRICI'1p`L RESOLUTION NO. 4006 A RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY OF SAID CITY REQUIRE, FOR PUBLIC USE, CERTAIN LAND LOCATED IN THE CITY OF PALO ALTO, COUNTY OF SANTA CLARA, STATE OF CALIFORNIA FOR THE EL CAMINO REAL WIDENING PROJECT 64-1 The Council of the City of Palo Alto does RESOLVE as follows' SECTION 1. That the Council of the City of Palo Alto has found and determined, and hereby does find, determine and declare, that the public interest and necessity require the acquisition, construction and completion by the City of Palo Alto of the follow- ing public improvement, to wit: streets and street improvements and work auxiliary thereto in, over, across and upon the parcels of land hereinafter more particularly described. SECTION 2. That the taking of the following estates and interests in and to the parcels of land more particularly described in Exhibits "A" and "B", attached hereto and by this reference made a part hereof, is necessary for such improvement: (a) The fee simple title for street purposes in and to Parcels 1, 2, 3, 4, 5 6 7, 8, 9, 10 11, 37, 38, 39, 4o, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 54, 55, 56, 56-A, 57, 58, 59, 6o, 61, 63-A, 63-B, 64-A, 64-B, 65, 68, 69, 70, 71, 72, 73, 74, 75, 76, 77-A 77-B, 78, 79-A, 79-B, 8o, 81, 82, 83, 84, 85, 100, 101, 102,103, 104-A, 130 04-B4, ,5105j'6and71068, 99, , as more particularly described in said Exhibit "A", reserving, however, to tha owners, their heirs, successors and assigns of Parcels 5, 46, 61, 89, 93, 94 and 95, the right to use the existing improve- ments which are located partially within and partially without the boundaries of said parcels. Such use shall terminate as to any said parcel in the event the improvement thereon is substantially damaged from any cause, in which event the reconstructed improvement must be situated without the boundaries of the parcels aforesaid. (b) Title to such entire existing improvements as are located partially within and partially without the boundaries of Parcels 8, 9, 11, 61, 68, 73, 76, 77B, 78, 99 and 104A, as more particularly described in said Exhibit "A", together with the right and easement to enter upon the larger parcels of which 1. the parcels aforesaid are a part, for the purpose of removing snid existing improvements at any time within 120 days after the date possession is authorized as indicated in the Order for Immediate Possession to be entered herein, or within 120 - days after final judgment in condemnation is entered herein. (c) The right and easement to enter upon the larger parcels of which Parcels 3, 10, 42, 43, 44, 46, 51, 57, 70, 82, 83, 87, 88, 97, 101 and 103 are a part, as more particularly described in said Exhibit "A", for the purpose of severing and removing therefrom those portions of said exist- ing improvements which lie within the boundaries of the parcels aforesaid at any time within 120 days from the date possession is authorized as indicated in the Order for immediate Possession to be entered herein, or within, 120 days after final judgment in condemnation is entered herein, (d) A temporary construction easement, limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for the purpose of providing a smooth e.xnection between the existing driveway and the proposed public improvement, and, likewise, for the purpose of modifying the existing slope of adjacent land to meet the back edge of the proposed sidewalk in and on Parcels 1(a), 37(a), 40(a), 43Sa), 44(a), 45(a), 49(a), 50(a) , 50 ,b) , 57(a) o0(a), 61(a � 74(a), 75a, 76(a), 77A(a), 77B(a), 84(a), 90(a;,75(a),104A (a)and 0(a) , as more particularly described in said Exhibit ".B". (e) (f) (g) A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for the purpose of providing a smooth connection between the existing driveway and the proposed public improvement in and on Parcels 5(a), 7(a), 8(�), 10 a 11(a), 42(a), 43(b), 51(a 52(a). 52(b), 72 a , 73(a), 80(a), 81(a), 82(a), 83(a), d4(b), 89 a , and 95t(a), as more particularly described in said Exhibit "B". A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for the purpose of modifying the existing slope of adjacent land to meet the back edge of the proposed sidewalk in and on Parcels 56(a), 59(a) and 61(b?, as more particularly described in said Exhibit 'B"e A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for the purpose of providing a smooth connection between the existing driveway and the proposed public improvement and for the purpose of relocating the existing drain- age drop inlet in and on Parcel 2(a), as more particularly described in said Exhibit "B", (h) A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work 2. • • of improvement may be accomplished, for access and for the purpose of storing thereon and removing therefrom materials and supplies and equipment relating to the work of bridge construction and channel improvement of the public improvement in and on Parcel 50(c), as more particularly described in said Exhibit ' B" . (1) (j) A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for access and for the purpose of storing thereon and removing therefrom materials and supplies and equipment relating to the work of bridge construction and for the further purpose of providing a smooth connec- tion between the existing channel and the proposed public improvement in and on Parcels 1(b), 55(a), 56(b),104A(b)and 104E:a), as more particularly described in said Exhibit "B". A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for the purpose of providing a smooth connection between the existing driveway and the proposed public improve- ment and for the further purpose of constructing a retaining wall in and on Parcels 39(a), 55(b) and Mj(a), as more particularly described in said Exhibit "B". (k) A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for the purpose of constructing a retaining wall on Parcels 54(a), 79B(a) and 80(b), as more particularly described in said Exhibit "B". (1) A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for the purpose of providing a smooth connection between the existing driveway and the proposed public improvement and for the further purpose of con- structing a retaining wall, on Parcel 54(b), as more particularly described in said Exhibit "B". (m) A temporary construction easement limited in time to December 31, 1969, or such earlier time as the work of improvement may be accomplished, for the purpose of providing a smooth connection between the existing driveway and the proposed public improvement and for the purpose of modifying the existing ground slope in and around the existing tree in and on Parcel 58(a), as more particularly described in said Exhibit "B". SECTION 3. That said proposed acquisitions and improvements are planned and located in a manner which will be most compatible with the greatest public good and the least private injury, and all of said acquisitions are situated within the City of Palo Alto, County of Santa Clara, State of California. 3. 1 1 SECTION 4. That the Council of the City of Palo Alto hereby declares its intention to acquire the estates and interests hereinabove more particularly designated in and to the parcels of land more particularly described in said Exhibits "A" and "B" under eminent domain proceedings; and the City Attorney of the City of Palo Alto and the law firm of Wilson, .Jones, Morton & Lynch, employed for that purpose, are hereby directed to institute and conduct to conclusion an action in eminent domain for the acquisition of said property and to take such action as is necessary therein, and said law firm of Wilson, Jones, Morton & Lynch shall be paid a reasonable fee therefor. SECTION 5. The City Manager is hereby authorized and directed as an alternative to trial of any action in eminent domain initiated hereunder to purchase for such reasonable sums as he may deem appropriate the several parcels of land aforesaid and to cause to be drafted, executed and delivered on behalf of the city all documents, either to be used within or without the condemnation proceeding aforesaid, necessary or convenient to accomplish this purpose. SEC•T.ON 6. The City Manager is further authorized to spend from general funds of the City heretofore appropriated for such purposes such monies as are necessary and in his opinion may constitute the fair market value of each of said parcels based upon appriasals of duly qualified and competent real estate appraisers. SECTION 7. That Orders for Immediate Possession and Use. be obtained in said action for all or such of the parcels of land aforesaid as may be required from time to time in connection with the schedule of construction of said improvement, and the Controller of t•he City of Palo Alto draw his warrants to the County Clerk, Santa Clara County, in such sums as may be determined by the Court, from time to time, to be so deposited as a condition to the right of immediate possession therefor, 4. • • SECTION 8.
