RESOLUTION NO. 4002
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND
NECESSITY OF SAID CITY REQUIRE, FOR PUBLIC USE FOR
PUBLIC GROUNDS, CERTAIN LAND LOCATED IN THE CITY OF
PALO ALTO, COUNTY OF SANTA CLARA, STATE OF CALIFORNIA,
FOR THE EXPANSION OF STATION "S"
The Council of the City of Palo Alto does RESOLVE as
follows:
SECTION 1. That the Council of the City of Palo Alto
has found and determined, and hereby does find, determine and
declare, that the public interest and necessity require the
acquisition, construction and completion by the City of Palo Alto
of the following public improvement, to wit: public grounds for
the expansion of electric power station known as Station "S".
SECTION 2. That the taking in fee simple of the property
described as Parcels 1 and 2 in EXHIBIT A attached hereto and
delineated on the map marked EXHIBIT B attached hereto and by
reference made a part hereof, situated in the City of Palo Alto,
County of Santa Clara, State of California, is necessary for
such improvement.
SECTION 3. That said proposed acquisition and improvement
is planned and located in a manner which will be most compatible
with the greatest public good and the least private injury, and
all of such acquisition is located within the territorial limits
of the City of Palo Alto.
SECTION 4. That the Cc'incil of the City of Palo Alto
hereby declares its intention to acquire title in fee simple in
said land described in EXHIBIT A under eminent domain proceed-
ings, and the Office of the City Attorney of the City of Palo
Alto and the law firm of Messrs. Wilson, .Tones, Morton & Lynch,

employed for that purpose, are hereby directed to institute and
conduct to conclusion an action in eminent domain for the acqui-
sition of said property in fee simple, and to take such action
as is necessary therein.
SECTION 5. 'ne City Manager is hereby authorized and
directed, as an alternative to trial of any action in eminent
domain initiated hereunder, to purchase for such reasonable sum
as he may deem appropriate, an option on the real property des-
cribed in said EXHIBIT A, said option to grant to the City the
exclusive right and option to purchase said parcel.
SECTION 6. The City Manager is further authorized to
spend from general funds of the City appropriated for such pur-
poses such monies as are necessary and as in his opinion may
constitute the fair market value of said parcel based upon
appraisals of duly qualified and competent real estate
appraisers.
SECTION 7. The City Clerk shall certify to the adoption
of this resolution by a vote of two-thirds of all of the
members of the City Council.

PROPERTY DESCRIPTION
All that real property located in the City of Palo Alto,
County of Santa Clara, State of California, described as follows:
Parcel 1:
BEGINNING at the point of intersection of the south-
easterly line of Colorado Avenue, 60 feet wide, with the
southwesterly line of the Wooster Canal, as established by
Final Decree of Condemnation entered April 17, 1946 in the
Superior Court of the State of California, in and for the
County of Santa Clara, in action entitled, City of Palo Alto,
a municipal corporation vs. Mackay Radio and Telegraph Co.,
a corporation, et al, Case No. 61804, a certified copy of said
Decree was filed for record on April 17, 1946, Book 1332 Offi-
cial Records, page 443, Santa Clara County Records; thence S.
55°49'20" W. along said southeasterly line of Colorado Avenue
208.32 feet to the point of intersection thereof with a north-
easterly line of that certain 0.060 acre tract of land des-
cribed in the Quit Claim Deed to City or Palo Alto, recorded
August 19, 1952 in Book 2472 Official Records, page 263, Santa
Clara County Records; thence S.43°41'40" E. along a north-
easterly line of said 0.060 acre tract 86.37 feet to an angle
point therein; thence S.35°23'40" E. along a northeasterly
line of said 0.060 acre tract 107.23 feet to the southernmost
corner thereof in the northeasterly line of that certain strip
of land designated "50 ft. Reserve" on the Map of C. M. Wooster
Company's Subdivision of the Clarke Ranch, filed in the office
of the Recorder of the County of Santa Clara, State of
California, on November 11, 1912, in Book "0" of Maps, page
16; thence S.43°40'40" E. along the northeasterly line of said
50 foot strip 41.34 feet to the point of intersection thereof
with the southeasterly line of that certain 10.00 acre tract
of land described firstly in the Deed to Federal Telegraph
Company, a corporation, recorded October 21, 1921 in Book 538
of Deeds, page 511, Santa Clara County Records; thence N.70°
05'20" E. along the southeasterly line of said 10 acre tract
371.89 feet to the point of intersection thereof with the
northwesterly line of the Matadero Canal (100 feet in width);
thence N.50°37'20" E. along said last mentioned line 58.96
feet to the point of intersection thereof with said south-
westerly line of the Wooster Canal; thence N. 70°25'20" W.
along said last mentioned line 396.11 feet to the point of be-
ginning, being a portion of Rancho Rincon de San Francisquito,
containing 1.939 acres, more or less.
Parcel 2:
BEGINNING at the point of intersection of the north-
easterl line of that certain strip of land designated "50 foot
Reserve" on the Map of C. M. Wooster Company's Subdivision of
the Clarke Ranch, filed in the office of the Recorder of the
County of Santa Clara, State of California, on November 11,
1912 in Book "0" of Maps, page 16 with the northwesterly line
of Matadero Canal, 100 feet wide; thence N. 50°37'20" E. along
said northwesterly line 341.31 feet to the point of intersection

thereof with the southeasterly line of that certain 10.00 acre
tract of land described firstly in the Deed to Federal Tele-
graph Company, a corporation, recorded October 21, 1912, in
Book 538 of Deeds, page 511, Records of Santa Clara County;
thence S. 70°05'20" W. along said southeasterly line 371.89
feet to the point of intersection thereof with said north-
easterly line; thence S. 43°40'40" E. along said northeasterly
line 124.29 feet to the point of beginning, being a portion of
Rancho Rincon de San Francisquito, containing 0.486 acres, more
or less.
