Home My WebLink AboutRESO 39934 • • RESOLUTION NO. 3993 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING RESOLUTION NO. 3964 TO CORRECT DESCRIPTION ATTACHED THERETO The Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. That said Council heretofore adopted Resolution No. 3964 determining necessity and authorizing the institution of a condernna- tion proceeding against Parcels 1 and 2, taking the fee simple title to Parcels 1 and 2 as described in Exhibit A, attached thereto and incorpor- ated therein by reference and likewise delineated on a reap marked Exhibit B, attached thereto and incorporated therein by reference. SECTION 2. That through inadvertence and error, the descrip- tions of Parcels 1 and 2 in said Exhibit A were erroneous and said parcels are likewise erroneously delineated on said Exhibit B. SECTION 3. NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED as follows: 1. That said Resolution No. 3964 be and the same is hereby amended by striking therefrom the description of Parcels 1 and 2 set forth in said Exhibit A and by inserting in lieu thereof the true and correct descriptions of said Parcels 1 and 2 as more particularly described in Exhibit A-1, attached hereto and by this reference incorporated herein. 2. That said Resolution No. 3964 be and the same is further amended by striking therefrom said Exhibit B and inserting in lieu thereof the map attached hereto, marked Exhibit B-1 and by this reference incorporated herein. Z. - 1. 1 Mayor - 2 - 7 PROPOSED SITE, ELECTRIC SUBSTATION H PROPERTY DESCRIPTION All that real property located in the City of Palo Alto, County of Santa Clara, State of California, described as follows: Parcel 1: BEGINNING at the paint of intersection of the northerly line of East Meadow Drive -(60 feet wide) with the westerly right of way line of Adobe Creek (80 feet wide), said point of beginning being a corner of that certain parcel of land described as PARCEL A in that certain Deed of Dedication recorded February 11, 1958 in Book 4003 of Official Records at page 409, records of Santa Clara County, California; thence N. 0° 311 21" E. along said westerly line 341.84 feet to the True Point of Beginning; thence along the westerly and southwesterly right of way line of said Adobe Creek the following courses and distances: N. 0° 311 21" E. 190.71 feet; along the arc of a tangent curve to the left having a radius of 164 feet, through a central angle of 39° 271 01", for an arc length of 112. 92 feet; and N. 38° 551 40" W. 61.37 feet; thence leaving said southwesterly line S. 51° 041 20" W. 183. 05 feet, to a point on a line which is parallel to and distant 5.00 feet northeasterly, measured at right angles, from the northeasterly line of that certain 15 foot wide easement described as Parcel 5 in the Final Order of Condemnation recorded in Book 2495 of Official Records at page 351, records of said County; thence southeasterly along said parallel line S. 45° 28' 17" E. 215.00 feet and S. 38° 551 40" E. 99.25 feet to the True Point of Beginning, containing 0. 839 acres, more or less, and being a portion of the Rancho Rincon de San Francisquito. That the City of Palo Alto file with the Department of Public Works of the State of California a petition for permission to accumulate funds apportioned pursuant to the provisions of Streets and Highways Code sections 186.1 et seq., and that the City Engineer be and he is hereby authorized and directed to execute and deliver such petition. A copy of the petition is attached hereto and made a part hereof.
