HomeMy WebLinkAboutRESO 3991• RESOLUTION NO. 3991 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO OF ITS INTENTION TO ORDER THE VACATION OF A PORTION OF GRANT AVENUE AND RESERVING ALL EASEMENTS THEREFROM The Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. It is the intention of the Council of the City of Palo Alto, subject to the reservations and exceptions set forth hereinafter, to vacate a portion of a public street commonly known as Grant Avenue lying between Birch Street and Park Boulevard in the City of Palo Alto, County of Santa Clara, State of California, as shown on a map attached hereto marked EXHIBIT A and further described in EXHIBIT B attached hereto and by reference made a part hereof. It is the intention of the Council of the City of Palo Alto that said vacation shall occur on June 30, 1967. SECTION 2. It is further the intention of the Council of the City of Palo Alto to reserve and except from said vacation easements in, on, over, across and under the entire area of said street for the purpose of constructing, reconstructing, maintaining, operating, replacing, removing, and enlarging sanitary sewers and public utilities. SECTION 3. Monday, the 15th day of May , 1967, at 7:30 p.m., in the Council Chambers, City Hall, Palo Alto, California, is set as the time and place of hearing where and when any person having an interest in such proceedings may appear and present evidence either for or against such vacation. SECTION 4. All of the proceedings for the vacation of said street, and said reservation of easements, shall be conducted pursuant to Section 8300 et seq. of the Streets and Highways Code. SECTION 5. The City Engineer is directed to post notices of street vacation and reservation of easements conspicuously along the street to be vacated as described in Section 1 hereof at 0 least 10 days before the hearing, posting them no more than 300 feet apart, but there shall be at least three notices posted. Such notices shall state the passage of this Resolution of Intention, and the time and place of the hearing. SECTION 6. The Clerk is directed to publish a copy of this resolution in the Palo Alto Times twice prior to the date of hearing. INTRODUCED AND PASSED: April 24, 1967 AYES: NOES: ABSENT: ATiTEST: Arnold, Beahrs, Cooley, Debs, Dias, Flint, Pearson, Rohrs, Sher, Worthington None Comstock, Rus lerk APPROVED AS TO FORM: A t ng City Attorney APPROVED• Mayor 2 • DESCRIPTION OF PORTION OF GRANT AVENUE PROPOSED TO BE ABANDONED BEGINNING at a point on the southeasterly line of Lot 91 of the Paul Survey, a map of which was recorded July 9, 1867 in Book C of Miscellaneous Records at page 641, Records of Santa Clara County, California, distant thereon 1.00 feet southwesterly from the most easterly corner of said Lot; thence southwesterly along said southeasterly line and its south- westerly prolongation 351.57 feet; thence along the arc of a tangent curve to the right having a radius of 10.00 feet, through a central angle of 90. 00' for an arc length of 15.71 feet, to a tangent point on the northeasterly line of Birch Street (70 feet wide); thence southeasterly along the southeasterly prolongation of said northeasterly line 80.00 feet; thence northwesterly along a tangent curve to the right having a radius of 10.00 feet, through a central angle of 90' 00' for an arc length of 15.71 feet to a tangent point on the northwesterly line of Lot 1, Block 3 of the W._'Hawxhurst Subdivision, a map of which was recorded June 6, 1868 in Book B of Miscellaneous Records at page 642, records of said County; thence northeasterly along said northwesterly line of Lot 1 and its northeasterly prolongation 351.57 feet, to a point on the southwesterly line of Park Boulevard (60 feet wide); P thence northwesterly along the northwesterly prolongation of said last named line 60.00 feet,to the point of beginning. EXHIBIT B
