RESOLUTION NO. 3957
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
DECLARING THAT THE PUBLIC INTEREST OR CONVENIENCE
REQUIRES THE DISCONTINUANCE OF THE USE OF CERTAIN
LANDS AS A PUBLIC PARK AND THAT THE COUNCIL INTENDS
TO CALL A SPECIAL ELECTION TO SUBMIT THE QUESTION
OF DISCONTINUANCE TO THE CITY ELECTORS
WHEREAS, pursuant to the requirements of Article VIII of
the Charter of the City of Palo Alto, the Council did by Ordinance
No. 2252 dedicate lands known as Byxbee Park and the City -owned
Baylands, the Municipal Golf Course, and the Palo Alto Yacht
Harbor for park purposes, and
WHEREAS, the Council desires to lease a portion of each of
said lands as delineated on the map marked EXHIBIT A and as more
particularly described in EXHIBIT 8, attached hereto, to the County
of Santa Clara for development and use as an airport,
NOW, THEREFORE, the Council of the City of Palo Alto does
hereby resolve as follows:
SECTION 1. That the public interest or convenience requires
the discontinuance of the use as a public park of lands described
in said EXHIBITS A and B, which exhibits are hereby made a part
hereof as though fully set forth herein, for the purpose of
leasing said lands, together with other undedicated land, to the
County of Santa Clara for the development and operation of an
airport.
SECTION 2. That the Council intends to call an election
for the purpose of submitting the question of such discontinuance
to the city electors provided that on or before April 3, 1967 the
County of Santa Clara executes the revised "Lease Agreement -
Palo Alto Airport" as approved by the Council on December 12, 1966.
SECTION 3. That March 13, 1967 at 7:30 p.m. in the Council
Chambers of the City Hall in the City of Palo Alto is hereby fixed
as the time and place at which the public or persons particularly
interested may protest such discontinuance.

thereof. Such protests shall be delivered to the City Clerk at
the City Hall.
SECTION 5. The City Engineer shall cause at least three
notices of the adoption of the resolution to be posted conspicu-
ously not more than three hundred feet apart along the exterior
boundaries of the area proposed to be discontinued or abandoned
as a public park. Posting shall be completed at least twenty
days before the time set for the hearing. Failure to post the
notices shall not invalidate the proceedings or prevent the
Council from acquiring jurisdiction to proceed with the discon-
tinuance and abandonment. The posted notices shall be headed:
"Notice of proposed discontinuance of public park land" in
legible characters, state the date of adoption of the resolution,
and recite the facts contained in the resolution.

DESCRIPTION OF PORTION OF BAYLANDS TO BE ABANDONED
Beginning at the southwesterly corner of that certain 26. 66 acre
tract conveyed to the City of Palo Alto by Peter Faber and Laura E. Faber
by deed recorded July 19, 1926 in Volume 246 at page 168, records of San
Mateo County, California; thence S. 65° 00' E. along the southwesterly line
of said tract and its southeasterly prolongation 240.24 feet; thence S. 63°15'
E. 152.40 feet; thence N. 51°37'00" E. 603.71 feet; thence N. 38°23'00" W.
479.18 feet; thence N. 8'23'26" E. 600.00 feet; thence N. 36°39'50" E.
620.99 feet to the True Point of Beginning, said True Point of Beginning
being designated as "Point N" on the map entitled "Palo Alto Airport
Lease Lands Exhibit -A" attached to the lease agreement between the City
of Palo Alto and the County of Santa Clara dated March 16, 1964, and
filed in the office of the City Clerk of the City of Palo Alto (Agreement
No. 2276); thence along the northerly line of Parcel A as shown on said
map N. 50°33'45" W. 1471.40 feet; N. 0°41'30" E. 95.01 feet and N.
40°51'30" W. 1308.00 feet; thence leaving said northerly line N. 50°57'00"
E. 316.20 feet; thence S. 38°25'00" E. 2872.72 feet; thence N. 50°33'4"
W. 51.37 feet, to the True Point of Beginning, containing 14. 629 acres
more or less.
DESCRIPTION OF PORTION OF GOLF COURSE TO BE ABANDONED
Beginning at the southwesterly corner of that certain 26. 66 acre
tract conveyed to the City of Palo Alto by Peter Faber et ux by deed re-
corded July 19, 1926 in Volume 246 of Official Records at page 168,
records of San Mateo County, California; thence S.47°30'00" W. 152.46
feet to a point on the general southwesterly line of that certain tract of
land shown as PARCEL "A" on the map entitled "Palo Alto Airport
Lease Lands Exhibit -A" attached to the Lease Agreement between the
City of Palo Alto and the County of Santa Clara dated March 16, 1964 and
filed in the office of the City Clerk of the City of Palo Alto (Agreement
No. 2276); thence along the general southwesterly line of said lease, the
following courses and distances: West 134. 50 feet; N. 17°08'00" W.
314.60 feet; North 720. 70 feet; East 232. 00 feet; North 80. 00 feet; West
42.00 feet and North 150. 00 feet to the True Point of Beginning; thence,
continuing along said general southwesterly line of said lease, East i50. 00
feet, North 642.02 feet and N. 38°25' W. 337. 96 feet; thence leaving said
general southwesterly line South 906.82 feet; thence East 60. 00 feet to the
True Point of Beginning, containing 3. 733 acres more or less.
DESCRIPTION OF PORTION OF YACHT HARBOR TO BE ABANDONED
Beginning at the southwesterly corner of that certain 26. 66 acre
tract of land conveyed to the City of Palo Alto by Peter Faber et ux by deed
recorded July 19, 1926 in Volume 246 of Official Records at page 168,
records of San Mateo County, California; thence South 65°00'00" E. 240. 24
feet; thence S. 63°15'E. 152.40 feet; thence N. 51°37'00" E. 25.32 feet to
the True Point of Beginning; thence East 1043. 38 feet; thence North 350.00
feet; thence N. 15°05'00" E. 345.00 feet; thence N. 64°55'00" W. 530.00
feet; thence N. 38`25'00" W. 530 feet, more or leas, to a point on the
Westerly shoreline of a lagoon, said shoreline also being the most westerly
line of that certain tract of land shown on Exhibit "E" attached to the Palo
Alto Yacht Harbor lease agreement between the City of Palo Alto and the
County of Santa Clara dated March 25, 1963, and filed April 12, 1963 in

the office of the City Clerk of the City of Palo Alto (Agreement No. 2275);
thence in a general southerly direction along the westerly line of said
leased lands and said shoreline 1275 feet, more or less, to a point
designated as "Point W." on the map entitled "Palo Alto Airport Lease
Lands Exhibit - A" attached to the lease agreement between the City of
Palo Alto and the County of Santa Clara dated March 16, 1964 and filed
in the office of the City Clerk of the City of Palo Alto (Agreement No.
2276); thence S. 63°17'56" W. along the southeasterly line of said Airport
Lease Lands 407.07 feet; thence S. 51°37' W. 578. 39 feet, to the True
Point of Beginning, containing 16 acres, more or less.
