JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALO ALTO AND THE BOARD OF TRUSTEES OF THE PALO ALTO
UNIFIED SCHOOL DISTRICT REQUESTING LEGISLATION
ELIMINATING THE WELFARE EXEMPTION FROM PROPERTY TAX
FOR CERTAIN LUXURY LIFE -CARE HOMES FOR THE AGED.
WHEREAS, Revenue and Taxation Code Section 214 and inter-
pretations thereof presently allow certain luxury life -care
homes for the aged to claim exemption from property tax pur-
suant to the welfare exemption stated in said code; and
WHEREAS, the City Council of Palo Alto and the Board of
Trustees of the Palo Alto Unified School District are deeply
concerned about the erosion of the property tax base upon which
they depend for their financial support by the exemptions granted
such luxury life -care homes; and
WHEREAS, the City Council and the Board of Trustees have
observed the influx of certain institutions within -their taxing
area which erode the tax base; and
WHEREAS, the City Council and the Board of Trustees jointly
agree and believe that such welfare exemptions are not within
the intent and spirit of the legislative purpose behind Revenue
and Taxation Code Section 214.
NOW, THEREFORE, BE IT RESOLVED by the City Council and the
Board of Trustees that they hereby jointly support all legislation
that will:
(1) Disallow the welfare exemption from property tax luxury
life -care homes for the aged where such exemption is clearly
inappropriate.
(2) Keep in force the welfare exemption for those truly
charitable and eleemosynary institutions caring for the needy
aged.
(3) Provide procedures whereby organizations entitled to the
welfare exemption may apply for such relief.
(4) Prevent the erosion of the property tax base by appropriate
legislation.
BE IT FURTHER JOINTLY RESOLVED BY THE CITY COUNCIL AND THE
BOARD OF TRUSTEES that the California Legislature immediately
draft and adopt legislation to accomplish the above -described
purpose.
These parties jointly believe that such a bill is needed to
insure the financial stability of local municipalities and school
districts in California.
Passed and adopted by the City Council of the City of Palo
Alto at a regular meeting held Monday the 9th day of January,
1967, by the following vote:
