HomeMy WebLinkAboutRESO 3950w• W,l: KIJ: gt 6/1/66 25C RESOLUTION NO. 3950 A RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS CALIFORNIA AVENUE AREA PARKING PROJECT NO. 65-9 RESOLVED, by the Council of the City of Palo Alto, California, as -follows: 1. That it does hereby preliminarily determine that the public interest and convenience require, and that it intends to order the following work to be done, acquisitions and improvements to -be made, to wit: a) The construction of -a multi -story off-street motor vehicle parking garage on the existing parking lot of the Cali- fornia Avenue Area Parking District bounded southwesterly, southeasterly and northeasterly by alleys and northwest- erly by Cambridge Avenue. b) The acquisition -of the southwesterly 121.37 feet of the southeasterly 130 feet of the block bounded by California Avenue, Birch Street, Sherman Avenue and Ash Street, and the improving thereof as an off-street motor vehicle park- ing lot and of existing public ways to be• used for ingress thereto and egress. therefrom, by grading and the construc- tion therein -of base pavement, wearing surface, curbs, gutters, drainage'facilities, lighting facilities, strip- ing, landscaping, and all auxiliary work necessary to complete the same as off-street automobile parking facilities. c) The acquisition of all lands, easements and facilities and the construction'of all work auxiliary to any of the above and nepessary to complete the same. 2. All of the blocks, streets and alleys herein mentioned are shown on maps of record in the office of the County Recorder of Santa Clara County, State of California, and shall be shown on the plans herein referred to and to be filed with the City Clerk of said City. 3. Whenever any public way is herein referred to as running between two public ways, or from or to any public way, the inter- sections of the public ways referred to are included to the extent that work shall be shown on the plans to be done herein. 4. All of said work and improvements are to be constructed at the places and in the particular locations, of the forms, sizes, • dimensions and materials, and at the lines, grades and eleva- tions as shown and delineated upon the plans, profiles and speci- fications to be made therefor, as hereinafter provided. 5. There is to se excepted from the work above described any of such work already done to line and grade and marked excepted or shown not to be done on said plans, profiles and specifications. 6. Said Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles and specifications. All such grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of Palo Alto. 7. Notice is hereby given of the fact that in many cases said work and improvement will bring the finished work to a grade different from that formerly existing, and that to said extent said grades are hereby changed and that said work will be done to said changed grades. 8. The descriptions of the acquisitions and improvements and the termini of the work contained in this resolution are general in nature. All items of work do not necessarily extend for the full length of she description thereof. The plans and profiles of the wcirk and the map and descriptions of the acquisi- tions, as contained in the Engineer's report, shall be contrciling as to the correct and detailed description thereof. 9• That the' costs and expenses of said acquisitions and improvements thereft$ are hereby made chargeable upon an assessment district, which district said Council declares to be the district benefited by said acquisitions and improvements, and the exterior boundaries of which are described and shown on the map identified as "Map Showing Boundaries of -2- Proposed Assessment District, Project No. 65-9", on file in the office of the City Clerk, which indicates by a boundary line the extent of the territory included within the -assessment district and which shall govern for all details as to the extent of said pro- posed district. 10. Said Council further declares that all public streets, highways, lanes and alleys and other publicly owned and otherwise non-taxable property within said assessment district shall be omitted from the annual benefit or ad valorem assessments hereafter to be made to pay principal and interest on bonds. 11. Notice is hereby given that serial bonds to represent the total cost of the project shall be issued pursuant to Bond Plan G, Section 40.507 of Division 5 of the Palo Alto Municipal Code, being the Palo Alto Improvement Procedure Code, the last installment of which bonds shall mature -rot to exceed twenty-four 12k) years from the 2nd day of July next succeeding ten months from their date. 12. The rate of assessment to be levied against taxable lands and improvements in the ratio of adjusted square footage of floor areas of commercial structures, as provided in said Bond Plan G, shall in no.event exceed $ ./5-7 per adjusted square foot; provided, that in the event that the proceeds of an assess- ment levied at the said maximum rate in any year are insufficient to raise the amount of money necessary to be raised by assessments to pay principal and interest on said bonds in said year, the balance shall be raised by an additional.asses3n2ent on all taxable lands (exclusive of improvements) within the -parking assessment district, in the ratio of their assessed valuation as said valua- tion appears on the Assessor's roll for the current fiscal year, all as provided in said Bond Plan G. 13. Except as herein otherwise provided for the issuance of • bonds, all of said work shall be done as provided in Sections 40.404 and 40.405 of Division 4 of said Code, and Division 4 of the Streets and Highways Code of the State of California. Reference is made to the proceedings taken pursuant to said _Division 4 of said Streets and Highways Code on file in the office of the City Clerk. 14. Said acquisitions and improvements are hereby referred to the City Engineer of said City, as the officer having charge and control of the acquisition and construction of public improvements in and for said City of the kind described herein, being a competent person employed by said City for that purpose, and said Engineer is hereby directed to make and file with the City Clerk of said City a report in writing, presenting the followings (a) Naps and descriptions of lands, easements and rights to be acquired; (b) Plans and specifications of the proposed improvements to be made pursuant to this Resolution; and (c) Engineer's estimate of the total costs and expenses of said acquisitions and improvements and of the incidental expenses in connection therewith. 15. Any surplus remaining from the proceeds of sale of the bonds to be issued under Bond Plan G shall be deposited in the bond interest and redemption fund for said bonds. 1 hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the Council of the City of Palo Alto, California, at a meeting thereof held on the 3rd day of January, 1967, by the following vote of the members thereof: AYES and in favor thereof, Councilmen: Arnold, Beaters, Comstock, Cooley, Dias, Flint, Pearson, Rohrs, Woodward, Worthington NOES, Councilmen: Debs ABSENT, Councilmen: Rue, Sher C y .
