I 1 ••• • RESOLUTION NO. 5172 -- RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO DETElUfiNING THE GENERAL PREVAILING RATES OF PER DIEM WAGES IN CONTRACTS FOR PUBLIC WORKS FOR THE CITY OF PALO ALTO, PROVIDING FOR PUBLICATION OF SUCH RATES, AND RESCINDING RESOLUTION NO. 5040, ADOPTED DECEMBER 16, 1974 WHEREAS, under the provisions of Section 1773 of the Labor Code, a public body awarding a contract or undertaking public works must determine the general prevailing rate of per diem wages in accordance with standards set forth i~ said Code for each craft, classification, or type of worker needed to execute the contract; and WHERE...\S, the City Council has ascertained and-considered applicable wage rates established-py collective·ba~gaining agreements within the locality and in the-nearest labor market area, particularly the Santa Clara-San Benito Counties Building and Construction Trades Council wage scales; NOW~ THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Council hereby determines the general prevailing rate of per diem wages as of December 16, 1975, in the Palo Alto locality for all public works under contract to be that set forth in EXHIBIT A to be attached qereto and made a part hereof by reference upon publication by the County of Santa Clara. SECTION 2. The Council of the City of Palo Alto hereby finds that the enactment of this resolution is not a "project" within the meaning of that term as defined in Section 11.04.130 of the Palo Alto Municipal Code and, therefore, no environmental assessment is necessary. SECTION 3. The City Clerk hereby is directed to send a certiffed copy of this resolution to the Clerk of the Board of Supervisors of the County of Santa Clara, and said Co'llll.ty is authorized to publish said wage rates as required by law. SECTION 4. The City Clerk hereby is directed to send a certifrea copy of this resolution to the Director of Industrial Relations of the State of California.
