HomeMy WebLinkAboutRESO 5164ORIGINAL RESOLU'l'IO?l NO. 5164 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO RELATING TO THE DETACHMENT OF CERTAIN PROPERTIES FROM THE BARRON PARK FIRE DISTRICT WHEREAS, certain properties referenced herein were within the boundaries of the Barron Park Fire District and subsequently were annexed by the City of Palo Alto in 1965 by Ordinance No. 2258 as an uninhabited annexation designated as "El Camino - Maybell Annexationq; and WHEREAS, the detachment of ·said properties from said District was not a condition of said annexation; and WHEREAS, due to a subsequent lawsuit challenging said annexa- tion, the City of Palo Alto was precluded from treating said properties as incorporated until the conclusion of said lawsuit; and · WHEREAS, due to inadvertence and to the above-recited events, proceedings for detachment of said properties from said District were not commenced following annexation by the City of Palo Alto, by the District, or by the affected property owners, as allowed by the District Reorganization Act of 1965 (Govern- ment Code SS56000.et seq.),until the City of Palo Alto itself commenced such detachment proceedings in 1974 by Resolution No. 4991; and WHEREAS, said detachment proceedings were completed on September 30, 1975,. by said District; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION l. The Council of the City of Palo Alto hereby finds that proceedinqs for· detachment for the following pro- perties were not commenced following annexation due to excusable neqlect: Current Assessor·' s Parcel Number 137-24-4 137-24-5 137-24-6 137-24-7 137-24-26 137-24-28 Said properties are more particularly described in Exhibit "A" attached hereto and by reference made a part hereof as though fully set forth.herein. SECTION--2. The City Clerk is directed to file a certified copy of this' resolution with Mi"~-Pau1· Sagel:$ Administrative Analyst, County-Executive Office of the County of Santa Clara; Mr. John Eastburg, Director of finance, County of Santa Clara; and the Barron Park Fire District. r SECTION 3. The Council of the City of Palo Alto finds that this IS not a project as defined in Section 11.04.130 of the Palo Alto Municipal Code and, therP.fore, no environmental impact assessment is necessary. F.I..RE ,DISTRICT All that certa_in real property situated in the County of Santa Clara, State of California, and bounded by the followinq de- scribed lines: Beginning at the point of intersection of the northeasterly line of El Camino Real (100 feet wide) with the northeasterly prolonqation of the southeasterly line of Maybell Avenue (40 feet wide), said point of intersection being also an angle point in the corporate limits line· of the City of Palo Alto; Thence, along said.southeasterly line of Maybell Avenue, s 29° 33' 11" w 450.42" feet, to· a point of intersection thereof with the southeasterly prolongation· of the southwesterly line of Lot 3, Maybell Tract, a map of which was recorded June 19, 1905: in Book "K" of Maps, at pages 88 and 89, Records of said County; Thence, N 60° 26 1 49" W 415.46 feet along said southeasterly _prolongation-and the-southwesterly line of Lots 3 and 2 of said Maybell Tract to the southwesterly corner of said Lot 2; Thence, northeasterly N 29° 33' 11" E 677.17 feet-along the northwesterly line of said Lot 2 to a point of intersection thereof with the northeasterly line of El Camino Real; Thence, southeasterly s 31° 49' 19" E 473.311 feet along ~aid northeasterly line to the point of beginning, containing S.53 acres, more or less.
