RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING A TENTATIVE MAP FOR CERTAIN PROPERTY l<NOWN
AS 1003-1011 COLORADO AVENUE, GRANTING EXCEPTIONS AND
VARIANCES, SUBJECT TO CONDITIONS .
The Council of the City of Palo Alto does RESOLVE as fol-
lows:
SECTION 1. Pursuant to Title 18 and Title 21 of the Palo
Alto Municipal Code, the tentative map, creating ten parcels on
approximately 2.0+ acres of property, zoned R-1 and known as
1003-1011 Colorado Avenue in the City of Palo Alto, as shown
on the map recommended for approval by the Planning Conunission
and.incorporated herein by reference, is hereby approved with
exceptions and variances, on the basis of the following findings
and subject to conditions hereinafter set forth.
SECTION 2. The Council of the City of Palo Alto finds as
follows:
a. Lot 5 is on a cul-de-sac street and is re-
quired by Section 21.20.110 of the Palo Alto
Municipal Code to have an average depth of
100 feet, requiring an exception from said re-
quirement because Lot 5 does ·not have such
depth.
b. Lots 6 and 8 are required by Section
21.20.110 to have a minimum width at the
building sett.ack line of 60 feet, requiring
an exception from said requirement because
Lots 6 and 8 are each substandard by aQE~o~i
mately 20 feet.
c. The existing residence on Lot 9 will have sub-
standard front and· rear setbacks and the existing
residence on Lot 10 will have a substandard
street side setback as a result of the subdivision,
requiring variances from the requirements of
Sections 18.12.070, 18.12.080, and 18.12.090 of
the Palo Al.to Municipal Code.
d. The narrow width of the subject property which
pro~ibits normal lot design on both sides of
the new street; the small number of lots in
relation to the length of the new streetf and
the parallelogram ahape of the subject prope~ty
which burdens the street and' lot design are
special circumstances and conditions affecting
the property which makes the three exceptions
to the subdivision ordinance and the three
setback variances necessary for the preservation
and enjoyment of a substantial property right
of the petitioner1 such will be consistent
with sound subdivision planning and will not
be detrimental to the public welfare or to
other property in the territory in which the
property is situated.

SECTION 3. • • The conditions for approval are. as follows:
a.. The subdivider shall execute a grant deed
in favor of the City of Palo Alto for fee
title to the proposed cul-de-sac.
b. The owner shall grant a io• public utility
easement along the proposed 18' RCP storm
drain line.
c. The subdivider shall construct or install
all pp.blic improvements at his own expense
including, but not limited to, curb, gutter
and sidewalk along the northeasterly and
southwesterly side of the proposed cul-de-sac
respectfully, asphalt pavement, storm drainage
system, trees, and all public utilities and
street lighting.
d. The subdivider shall submit all proposed ..
roadway improvement plans, supporting cal-
culations, and ·soils report data for approval
by the City Engineer prior to the app~oval of
the final map by the City Council.
e. The subdivider shall construct a manhole and
a flap gate on the Seale-Wooster Canal at the
connection of the storm drain line. Design
details and hydraulic calculations shall be
submitted to the City for approval •.
f. The existing driveway which crosses Lot 10
and provides access to Lot 9 shall be eliminated.

q. Vtilities to Lot 9 shall be served from a
public utilities easement or from the public
way and shall not encroach upon Lot 10.
b. The sidewalk adjacent to Lots 6 through 10·
shall be contiguous to the· road curb. The
remainder of the sidewalk shall be as indicated
in the typical section on the p1~n with th~·· ·

i. ~ne subdivider shall execute an agreement for
the performance of all improvements required
hereunder and provide a surety bond or deposit
cash with the Ci~y Controller to guarantee the
completion of said improvements, pursuant to
Sections 21.24.170 and 21.24.180 of the Palo
Alto Municipal Code.
j. The subdivider shall preserve the 20• cork
oak tree in the public riqht-of-way adjacent
to Lots 4 and s.

SECTION 4. The Council finds that the proposed subdivision
and the exceptions and variances for lot depth, lot width, and
setbacks will have no adverse environmental impact and are in
conformity with the law and consistent with the General Plan
and the zonin9 at the site.
