HomeMy WebLinkAboutRESO 5084; .. • • ORIGINAL RESOLUTION NO. 5084 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO CALLING THE BARRON PARK ANNEXATION ELECTION TO BE HELD ON NOVEMBER 4, 1975 WHEREAS, on March 31, 1975, the Council of the City of Palo Alto adopted Resolution No. 5077 pursuant to Section 35116 of the Government Code declaring its intention to call an election to submit to the electors residing in the territory to be annexed the question of whether the territory known as "Barron Park" should be annexed to the City of Palo Alto: and WHEREAS, a hearing on the proposed annexation was held by the Council on April 21, 1975, pursuant to Section 35117 of the Government Code; and 1: WHEREAS, notice of said hearing was given as required by law; NOW, THEREFORE, the Council of the City of Palo Alto hereby does RESOLVE as follows: SECTION 1. The Council here~y finds that the value of the territory to be annexed does not equal one-half or more of that within the City of Palo Alto as shown by the ·last equalized assessment roll. The Council further finds that the number of qualified electors of the territory does not equal one-half or more of the number.of qualified electors .within the C1ty.of Palo Alto as shown by the County of Santa Clara re;istration of voters. SECTION 2. The Council hereby calls a special election to be held on November 4, 1975, in the territory hereafter described for the purpose of submitting to the qualified electors residing therein the question of whether said territory shall be annexed to, and incorporated within, the City of Palo Alto. SECTION 3. The name given to the. territory for the purpose of indicating it upon the election ballots is "Barron Park." The boundaries of the territory are described in Exhibit "A," attached hereto and made a part of this resolution by this reference. SECTION 4. The election shall be held within the territory described in said Exhibit "A." SECTION 5. At the election, there shall be submitted.to the qualified electorate in the territory the. following proposition: "BARRON PARK" A..'"iNEXATION MEASURE MEhSURE ( . ) Shall the territory known YES as "Barron Park" be annexed to, .incorporated in, and made a part of the City of Palo Alto? NO SECTION 6. Ballots for the election shall be provided of the form and to the nwnber provided by law. SECTION 7~. ~he hours of opening and closinq che polls shall be the same as provided for a general. city election. SECTION 8. The City Clerk is directed to obtain supplies necessary for the-proper conduct of the election and to have pre- pared and mailed a ballot pamphlet, a sample ballot, and a precinct polling place card as prescribed by law. • • SECTION 9. The City Clerk shall transmit a certified copy of this resolution by reqistered mail to the executive office of the Local Agency Formation Commission within five (5) days after its adoption as prescribed by law. SECTION 10. The City Clerk shall publish or post a synopsis of the measure to be voted upon in the manner provided in Section 22835 of the Elections Code. SECTION 11. The votinq precincts, polling places, and election officers shall be established by later resolution. SECTION 12. The City Clerk shall publish or post notice of election as required by Section 351~3 of the Government Code. SECTION 13. This resolution is adopted under Sections 35100 - 35158 of the Government Code. Except as .. otherwise provided in said sections, the ballots used, the opening and closing of -the polls, and the conduct of the election~shall conform as nearly .as possible with the Election Code provisions governing municipal elections in general ·1a~ citigs. The City Clerk hereby is authorized and directed to transmit certified. copies of this resolution to the Beard of Supervisors of Santa Clara County and to the Registrar of Voters of Santa Clara County. Berwald Cl C t k H d N P ~ , , ay, oms oc , en erson, orton, earson, Rosenbaum, Sher NOES: None ABSENT : None APPROVED: ~ ~~ city Manager -2- J?(.-t-tv) tt! ; (},o;;.L:'{'{[· l ,~'?:;·· .,. ;· ... • • PROPERTY DESCRIPTION PROPOSED ANNEXATION OF "BARRON PARK" TO CITY OF PALO ALTO All that certai-real property situate in the County of Santa Clara, State of California, described as follows: BEGINNING at the most westerly corner of that certain annexation to the City of Pal~ Alto entitled "El Camino Annexation No. 4," as set forth in Ordinance No. 2009, and adopted by the Palo Alto City Counc~l on April 27, 1961, said corner also being a point on the southeasterly line of that certain annexation to the City of Palo Alto entitled "Mayfield Consolidation," as set forth in Ordinance No. 318, and adopted by the Palo Alto City Council on July 6, 1925; THENCE meandering southeasterly along the southern boundary of said El Camino Annexation No. 4 to its intersection wi\:.h the southwesterly corner of that certain annexation to the City of Palo Alto entitled "El Camino Real i7," as set forth in Ordinance No. 2427, and adopted by.the Palo Alto City Council on May 6, 1968; THENCE southeasterly along the southern boundary of said El Camino Real i7 annexation to its intersection with the northwesterly boundary of that certain annexation to the City of Palo Alto entitled "El Camino-Maybell Annexation,r. as set forth in Ordinance No. 2258, and adopted by the Palo Alto City Council on September 27, 1965; THENCE southwesterly and southeasterly along the northwesterly and southwesterly line of said El Camino-Maybell Annexation to a corner point in the northwesterly line of that certain annexation to the City of Palo Alto entitled "Foothills Annexation No. 2," as set fort,h in Ordinance No. 1855, and adopted by the Palo Alto City Council on June 22t 195~; THENCE southwesterly, southeasterly and southwesterly along the northwesterly line of said Foothills Annexation No. 2 to the most easterly corner of ·that certain annexation t.o the City of Palo Alto entitled "Arastradero-Maybell Annexationn as set forth in Ordinance No. 2203, and adopted by the Palo Alto City Council on August 24, 1964; THENCE northwesterly, southwesterly, southeasterly, south- westerly, and northwesterly along the northeasterly and. northwesterly line of that said Arastradero-Maybell Annexation to its intersection with the general northwesterly line of . , s~id _FoC?t~ills Annexation.
