RESOLUTION NO. 5055
A RESOLUTION CALLING FOR SEALED PROPOSALS AND FlXING
LIQUIDATED DAMAGES FOR FAILURE TO COMPLE~E THE WORK
WITHIN TIME SPECIFIED
CALIFORNIA AVENUE AREA OFFSTREET PARKING
PROJECT NO. 71-63
RESOLVED, by the Council of the City of Palo Alto, California, that
WHEREAS, on Se~tember 10, 1974, this Council adopted its Resolution
of Intention No. 4993 to order the grading, excavation, removal of
existing structures, and the construction of pavement, striping, bumper
stops, curbs, guttersJ walkways, drainage improvements, lighting facili-
ties, signs, landscaping and-all auxiliary and related work necessary to
complete the same as offstreet motor vehicle parking facilities in said
City, and all as more particularly"described and set forth in ~aid Reso-
lution of Intention;
NOW, THEREFORE, the Clerk of this City is hereby directed to publish
once a week for two weeks in the Palo Alto Times, a newspaper published
and circulat.ed ·-~ n said City, a notice inviting sealed proposals or .bids

1 for the consti••1.ction and installation of said improvements, and refer-
ring to the plans and specifications on file in the office of said City
. ·Clerk, the first publication of which notice shall be at least ten (10)
days prior to the time fixed for opening bids.
All proposa1s•..>r bids·shall be accompanied by cash;·cashier's or
certified check payable to the order of the City Cler!{ amounting to ten
percent or the bi<!, or by a bond in said amount and payable to said
Clerk signed by the bidder and a corporate surety or by the bidder and
two sureties who shall justify before any officer competent to administer
an oath, in double said amount and over and above all statutory exemp-
tions. The a.Ltount so posted shall be forreited to said City in case the
bidder depositing the same does not, within fifteen (15} days after
written notice that--the contract has been awarded to him, entered i_nto a
con~ract with the City.
It is hereby determined that in the event the contractor, contract-
ing owners included, does nut complete the work within the tinie 11m1 t . ,/{

specifi~d in the proposed contract or within such further time as this
Council shall have authori~ed, th~ contractor or contracting owners, as
t~e case may be, shall pay to the City liquidated damag~s in the amount
of Fifty Dollars ($50.00) per day for each and every day's delay in
finishing th~ work beyond the completion date specified in said contract.
Additional provisions Nith regard to said time of completion and liquidate~
damages are ~et forth in the specifications, which provisions ~re hereby
referred to and incorporated herein by reference.
Said sealed proposals or bids shall be delivered to the City Clerk
on or before 3:00 o'clock P.M. on the 26th day of February, 1975, said
t.:rr.e ueing not less than ten (10) days from the time of first publica-
tion of said notice. Bids will be publicly opened, examined and declared
on said day and hour and referred to and considered by the Council at its
meeting at 7: 30 o'clock P. M. on 1'farch 17th , 1975.

Palo Alto, California, at a meeting there or held on the 27th day of
