RESOLUTION NO. 5054
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE TENTATIVE SUBDIVISION MAP FOR THE
PROPERTY LOCATED AT 4221 WILKIE WAY IN THE CITY OF
PALO ALTO AND GRANTING EXCEPTIONS SUBJECT TO CONDITIONG
WHEREAS, 1.18 acres of property zoned R-1 and located at
4221 Wilkie Way in the City of Palo Alto, being a portion of
Lot 8, Map of Subdivision of the Wm. Rowe Property, recorded
in Book "H" of Maps, Page 43, Santa Cla.ra County Records, and
ide~tified as Assessor's Parcel Nos. 147-43-92 and 147-43-93,
hereinafter referred to as the "subject property," is proposed
to be divid~d into five (5) parcel~; and
WHEREAe, Parcel 4 is a rear lot which is required by
Section 21.32.0SO(b) of the Pale Alto Municipal Code to have
an area which exceeds the area requirement of 6,000 square feet
of the R-1 District by 20 percent, exclusive of any acc~ss to
a public street,· and is required by Section 21.20.110 to have
not less than 100 feet average depth; and
WHEREAS, Parcel 4 therefore is substandard in area by
110 square feet ± und7r r~ar lot regulations, requiring an ex-
ception from the i.-equirements of Section 21. 32. 050 (b) of the
Palo Alto Municipal Code, and is substandard in d~pth by
approximately 16 feet, requiring an exception from the re-
quirements of Section 21.20.110 of the Palo Alto Municipal
Code; and
WHEREAS, Lots 3 and 5 are required by Section 21.20.110
to have a minimum width at the building setback line of
60 feet; and
WHEREAS, Lots 3 and 5 arE1! .. substandard in width at the
building setback line by approximately 25 and 10 feet respec-
tively, req~iring exceptions from the requirement of Section
21.20.110 of the Palo Alto Municipal Code;
. NOW, THEREFORE, the Council of the City of Palo Alto doe&
RESOLVE-as follows:
SECTION 1. The City Council finds that there are special
conditions affecting Parcels 3, 4, and S due to the dimensions
and geometry of the 1.18 acre property to be subdivided and the
cul-de-sac street and that the exceptions ~ranted herein are
necessary ':f:->r the preservation and enjoyment of a substantial
property right of the petitioner, and that the exceptions granted
herein will not be detrimental to the public welfare or injurious
to other property in the territory in which thi~ property is
situated.
SECTION 2. The City Council hex~by approves the tentative
subdivision map for dle subject property, as shown on the map
attached hereto and incorporated herein by reference, and grants
the exceptions to the requirements of Sections 21.20.110 and
21.32.0SO(b) of the Palo Alto Municipal Code, subject to the
following conditions:

A soils re:Port shall be submitted prior to approval
of the final map.
The name of the propoaed street (Christie Court) shall
be forwarded to the Finance and Public Works Committee
for approval.

3. The developer shall execute a grant dee(..· in favor of
the City of Palo Alto in fee title for the proposed
street right-of-way.
4. The developer-~hall apply for and pay all costs associ-
ated with abandonment of an existing drainage easement
across the pr.operty.
5. The subdivision improvement and cul-de-sac plan sub-
mitted to the City Engineer for approval shall include
grading plans of the four unimproved lots showing
proposed elevations of these lots in relation to
abutting developed propertie~.
6. The developer shall execute an agreement for performance
of all required public improvements and a surety bond
to guarantee completion of said public improvements
prior to the approval of t.iJe final map as ~equired by
Sections 21.24.170 and 21.2~.180 of the Palo Alto
Municipal Code.
7. A -zinal subdivisio~ map shall be submitted in accordance
with Chapt~r 21.16 of the Palo Alto Municipal Code and
Article 5 of the Subdivision Map Act.
8. The developer shall eliminate the Parking and Recreati~n
Easement shown on the plan.
9. The developer shall provide a 32-foot wide street
curb to curb.
10. The developer shall landscape and improve the green
strip located between the proposed street (Christie
Court) and lot 100 (which lies north of the proposed
subdivision) in accordance with ":he requirements of
the City ot Palo Alto Architectural Review Board.
Such improvements shall includ~ street trees and
ground cover, and may include decorative paving and
an underground sprinkler s:v··~tem to be automatically
controlled and metered to'tlle City of Palo Alto.
The strip shall be attached to Lot S, with a landscape
eas~ment granted to the City of Palo Alto.
SECTION 3. The City Council finds that granting the pro-
posed miscellaneous division of land and the exceptions for lot
area and lot widths at the building setback line will have no
significant environmental impact.
