HomeMy WebLinkAboutRESO 5030• • . • • ORIGINAL RESOLUTION NO. 5030 RESOLUTION OF THE COUNCIL OF Tire CITY OF PALO ALTO DECLARING ITS INTENTION TO ORDER THE .VACATION OF A PUBLIC UTILITIES EASEMENTr BEING A PORTION OF RANCHO RINCON OE SAN FRANCISQUITO, ANO SE'l"l'ING -A-H3ARING THEREON WHEREAS, pursuant to previous .agreement the City of Palo Alto -acquired the easement described below for public utility purposes1 and WHEREAS, the City of Palo Alto has undergrounded said utilities; and WHEREAS, the City of Palo Alto has .received an executed· Grant of Easement for the undergrounding of said utilities; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. It is the intention of the Council of the City of Palo Alto to vacate the easement acquired from THE BOARD OF TRUSTEES OF THE LELAND STANFORD JUNIOR. UNIVERSITY and .acquired for the purpose of installation, maintenance, and .operation of· .public utili ties--and appurtenances thereto, over and across. that certain parcel of land . situate in the City of Palo Alto, County· of Santa Clara, State of California, as described in Exhibit "A" and as set forth on a map ... entitled Exhibit 11B", both attached hereto and by reference made a part hereof. SECTION 2. Monday, the 16th day of December, 1974, at 7:30 p.m~ in the Council Chambers, Civic Center, 250 Hamilton Avenu&, Palo-Alto, California, is set as the time and .place of hearing where and when any person having an interest.in such .proceedings may appear and be heard either for or against such vacation. SECTION 3. All proceedings for the vacation of said ease- ment shall be conducted pursuant to Article 5 (commencing with • • • • · Section 50430), Chapter 2, Part 1, Division, Title 5 of the Government Code of the State of California. SECTION 4. The City Engineer is directed to post notices of this intention to vacate .conspicuously along the. easement to be vacated as described in Section· l· hereof at least ten ·(10) days before the hearing, posting· them no more than three hundred (300) feet apart, but there shall be at least three (3) notices posted. Such notices shall· state the· passage-of· this resolution of intention and the time and place of the hearing. SECTION s. The City Clerk is directed .to publish a copy of this resolution in the Palo. Alto Times once each week prior to .the date of hearing.
