RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
DECLARING ITS INTENTION TO ORDER THE VACATION OF
A SEWER EASEMENT, BEING A PORTION OF RANCHO RINCON
DE SAN FRANCISQUITO, AND SETTING A PUBLIC HEARING
THEREON
The Council of the City of Palo Alto does RESOLVE as follows:
SECTION l, It is the intention of the Council of the City
of Palo Alto, subject to certain conditions set forth herein-
after, to vacate an easement acquired for the purpose of instal-
lation, maintenance, repair and replacement of sanitary sewer
pipeline and any and all appurtenances thereto, under and upon
that certain parcel of land situate in the City of Palo Alto,
County of Santa Clara, State of California, as described in
EXHIBIT A and as set forth on a map entitled EXHIBIT B, both
attached hereto and by reference made a part hereof.
SECTION 2. Tuesday, the 29th day of October, 1974, at 7:30
p.m. in the Council Chambers, City Hall, Palo Alto, California,
is set as the time and place of hearing where and when any person
having an interest in such proceedings may appear and be heard
either for or against such vacation.
SECTION 3. It is further the intention of the Council that
vacation of the present easement is to be conditioned on the
affectod owner's obtaining and furnishing to the City a new
easement and relocation of the sewer line concerned within said
new easement, at his own expense, subject to the approval of the
Water-Gas-Sewer Division, and payment of all other costs related
to this vacation.
SECTION 4. All the proceedings for the vacation of said
easement shall be conducted pursuant to Title s, Division 1,
Article S of the Government Code of the State of California.
SECTION S. The Director of Utilities is directed to post
notices of this intent to vacate conspicuously along the easement
to be vacated as described in Sec~ion 1 hereof at least ten days
prior to the hearing, posting them no more than 300 feet apart,
but there shall be at least three notices posted. Such notices
shall state the passage of this resolution of intention and the
time and place of the hearing.
SECTION 6. The City Clerk is directed to publish a copy
of this resolution in the Palo Alto Times once each week prior
to the date of hearing~

ALL THAT CERTAIN REAL PROPERTY SITUATED IN THE CITY OF PALO ALTO,
COUNTY OF SANTA CLARA, STATE OF CALIFORNIA, DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF PARCEL 118 11 AS SAID
PARCEL 11 B11 IS SHOWN ON THAT CERTAIN PARCEL MAP FILED FOR
RECORD ON JULY 8, 1969 IN BOOK 256 OF MAPS, AT PAGE 7,
RECORDS OF SAID COUNTY;
THENCE FROM SAID POINT OF COMMENCEMENT, NORTH 9°26'23" EAST
ALONG THE EASTERLY LINE OF SAID PARCEL "B", A DISTANCE
OF 205.84 FEET TO A POINT ON THE SOUTHWESTERLY LINE OF THAT
CERTAIN 15.00 FOOT WIDE SEWER EASEMENT FILED FOR RECORD
-ON NOVEMBER 26, 1951 IN BOOK 2322, OFFICIAL RECORDS, AT
PAGE 118, RECORDS OF SAID COUNTY;
THENCE NORTH 46°31'02" WEST ALONG SAID SOUTHWESTERLY LINE
A DISTANCE OF 18.10 FEET TO THE TRUE POINT OF BEGINNING OF
THIS DESCRIPTION;
THENCE CONTINUING ALONG SAID SOUTHWESTERLY LINE (2322 OR 118)
NORTH 46°31'02" WEST, A DISTANCE OF 150.02 FEET;
THENCE SOUTH 80°33 1 37 11 EAST, A DISTANCE OF 26.79 FEET TO A
POINT ON THE NORTHEASTERLY LINE OF SAID 15.00 FOOT WIDE
SEWER EASEMENT (2322 OR 118) ;
THENCE SOUTH 46°31'02" EAST PARALLEL WITH AND DISTANT 15.00
FEET NORTHEASTERLY MEASURED AT RIGHT ANGLES FROM SAID
SOUTHWESTERLY LINE (2322 OR 118), A DISTANCE OF 117.69 FEET:
