I .. • cl.IGINAL RESOLUTION No. 4994 A RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING RULE 11 AND ADOPTING RULE 11.l OF THE UTILITY RULES AND REGULATIONS TO PROVIDE FOR SHORTAGE OF SUPPLY, INTERRUPTION OF DELIVERY, AND MANDATORY CURTAILMENT OF SERVICE, AND AUTHORIZING THE REVISION OF RULE 11.l AS SPECIFIED The Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. Pursuant to Section 12.20.010 of the Palo Alto Municipal Code, Rule 11 of Rules and Regulations governing utility services· in the Cit~: of Palo Alto, en- titled "SHORTAGE OF SUPPLY AND INTERRUPTION OF DELIVERY, .. is amended as shown upon the attachment hereto, which is incorporated herein and adopted by refe~ence. Said Rule 11 includes the Emergency Load Shedding Plan, as incor- porated by reference within Rule 11. SEC~ION 2. Pursuant to Section 12.20.010 of the Palo Alto MUnic1pal Code, Rule 11.1 of the Rules and Regulations .governing utility services in the City of Palo Alto, en- titled "PROHIBITIONS AND CURTAILMENT r·ROVISIONS, .. is added to said Rules a::1d Regulations. The City Manager is author- ized to revise Rule 11.1, as required, to parallel futur~ Public Utilities Commission conservation decisions, after notifying the City Council of the propose.d changes. The City Manager shall keep the City Council informed of elec- trical usage within the City and make any recorn.~endations for other conservation measures. EMERGENCY INTERRUPTIONS : The City will make reasonable efforts to prevent interruptions to service. When such interruptions occur, it will endeavor to re-establish service with the shortest possible delay consistent with the safety of its customers and the general public. The City will net be liable for interruptions or in- sufficiency of SU1}ply or any loss or damage occasioned thereby if the same is caused by accident, act of God, fire, strikes, riot, war, or any other cause except that arising from the City's failure to exercise reasonable diligence. B. SCHEDULED INTERRUPTIONS: Whenever the City finds it necessary to schedule an interruption to its service, it will, where feasible, notify all customers to pe affected of the approximate time and the anticipated duration of the interruption. Scheduled interruptions will be made at such hours as will provide the least inconvenience to the customers consistent with reasonable utility operations and cost. The City shall have the right to suspend service, temporarily, for repairs or improvements, and they will be made as rapidly as may be practical and safe. C. SHORTA~E OF SUPPLY: The City will exercise reasonable diligence and care to furnish and deliver continuous and sufficient utility service to its customers, but does not guarantee continuity of or sufficiency of supply. During times of threatened or actual shortage, the City will apportion its available supply among its customers in accordance with the "Emergency Load- Shedding Plans", incorporated herein by reference, on file in the Utilities Department. With due regard for public health and safety, these plans will provide for shortages caused by insufficient supply or natural or man-made events which reduce the capacity of the City's suppliers, and the City is requested to limit the level of delivery to its custo1Ders for some speci- fied period of time or "until further notice" •. ~ The City Manager is au- thorized to adjust the "Emergency Load-Shedding Plan" to reflect changes in personnel, times, systems, service, or other factors, when, in his opinion, said plan will be improved, made more equitable, will create the least harm to the City's system and its customers, or will best protect the public p~ace, health, safety, and general welfare. .,- Issued by The City Council Effective Date: September 10, 1974 ---------------------------------~ I. It will be in full force and effect until declared ineffective and r:ancelled by resolution of the City Council. B. PROHIBITED USES: (1) FUNCTIONAL OUTDOOR LIGHI'ING: (a) No customer shall make. cause, or permit any use of electrical energy for the floodlighting of outdoor commercial areas includ- ing. but not limited to. service stations, used car lots, new car lots, automobile parking lots, or similar businesses, between the hours of sunrise and sunset. and when not open for business. (b) Notwithstanding the provisions of subsection B.1.a. hereof, after sunset, when such activities are open. the use of electrical energy for such purposes shall be reduced to fifty percent (50%) of normal or usual levels. Furthermore, prohibited uses of electrical energy from the Utility are not applicable to that mininrJlll lighting necessary for public safety, or for security. or that required by law, or required for the lighting of e~sential governmental build- ings utilized for police, fire protection, health, and coD1Dunica- tions purposes. (2) COMFORT BEATING AND COOLING: (a) During business hours, no customer shall at any time make, cause. or permit any use of electrical energy in any commercial or in- dustrial establishment to provide heat to raise the temperature 0 therein above 68 F, nor to provide cooling to reduce tbe tempera-o ture therein below 78 F, except where other temperatures are specific~_lly required, by law. "11-.ere it is not established that a ne~ energy savings can be achieved by operating space-condition- ing equipment during nonbusiness hours, such equipment shall be tu-med off. City of Palo Alto California • • R.ULE AND REGULATION NO. 11.l PROHIBITIONS AND CURTAILMENT PROVISIONS (Continued) Original Sheet No. 27.2 (b) Notwithstanding the provisions of subsection B.2.a. hereof, any coDDP.rcial or industrial buildings where in the space-heatins and cooling-control systems provide for a single temperature set- point. or where such buildings are equipped with systems which heat and cool simultaneously or depend upon electric lighting as a part of the heating ('nergy, the space-conditioning systems shall be operated in a manner which minimizes electric energy use. (3) OUTDOOR PUBLIC GATHERINGS: No customer shall make, cause, or permit the use of electrical energy for recreational or cultural activities in excess of eighty-five per- cent (85%) of the normal or usual amount used by that customer for the same or similar activities. (4) INDOOR BUSINESS LIGHTING: (a) No customer shall make, cause, or permit the use of electrical energy for lighting the interior of any business establishment during that period of time that said establishment is not carrying on the usual and customary activities of tha\: business. (b) Notwithstanding the provisions of subsection B.4.a. hereof, a business establishment may provide sufficient illumination at all times to provide a minimal level of protection and security to persons and property. (c) Nothing in these subsections shall be construed to prohibit ordinary and customary ~ntenance and janitorial services at times other than those during which the business establishment is carrying on the usual and custmnary activities of that business. C. NOTIFICATION: The Utility shall notify the customer when it baa learned of a prohibited use as defined in Section B and. unless the customer will discontinue such use, Section D shall apply. The additions and modifications to the existing stop Signsystem as set forth in EXHIBIT B, consisting of a list entitled, "Stop Sign System Additions and/or Modifications,11 and a map entitled, 11 Proposed Modifications to Stop Intersection System-Septernbe~· 1974;" which are attached hereto and by reference made a part hereof, are hereby adopted. SECTION 2. The map which wa$ attached to Resolution 4291 as EXHIBIT' A' entitled, "Stop-Intersection System, 11 which is attached hereto as EXHIBIT A and by reference made a part hereof, is hereby amended accordingly. SECTION 3. The Council finds that the passage of this resolution will have no significant environmental impact. Addison/Waverley Addison/Cowper Addisoo/Bryant Addison Avenue is prei;ently designated a through street at its intersection with both Cowper and Bryant Streets, while Waverley Street is designated a through street at its intersection with Addison Avenue. The Downtown Neighborhood Study prepared in January of 1968 identified elements of unuecessary traffic infiltiation and parking problems in the residential neighborhood illllllediately south of Channing Avenue. Recently, residents of the "~dison AYenue Cmmnunity" submitted a detailed report to the staff for use as a resource document in reviewing and evaluating the need for additional 4-way stop intersections on Addison Avenue at Bryant, Waverley, and Cowper Streets. The report includes a petition section reflecting neighborhood support for the 4-way stop intersections as necessary "near-term action". In addition, Addison Avenue is a designated bicycle route street. The installation of a stop on Waverley Street would provide improved protection for bic:yc.lists and pedestrians crossing Waverley at Addison Avenue. There have been five reported right-angle acridents at the Addison/Waverley intersection during the last five year period. Visibility limitations at the Addison/Waverley intersection caused by a series of large tree trunks along the ~orthbound approach of Waverley Street reinforce the need foT a 4-way stop intersection at this location. Churchill/Cowper Churchill is designated a through street at its intersection with Cowper. Field investigations indicate there is limited visibility at this inter sec ti on. Such limited visibility problems can only be ameliorated by the installation of a 4-way stop at this intersection. There have been nine right-angle Page 1 of 3 . . . . • accidents during a five year period at this location. It is expected that a 4-way stop intersection will help reduce both the accident frequency and rate at this location. IV. Colorado/Ross Colorado Avenue is presently designated a through street at its intersection with Ross Road. The accident history indicates that of the seven accidents rec~rded during a three year period at this intersectiQii, five have been caused by right-of-way violations. It is expected that a 4-way stop inter- section will help ameliorate the vehicular right-of-way problems at this intersection. V. Colorado/Bryant Bryant Street is presently a through street at its intersection with CDlorado Avenue. The traffic signal at the intersection of Bryant Street and the Oregon Expressway tends to attract and encourage traffic to use Bryant Street. Consequentlyt noticeable increases in traffic volUilleS and speeds have been observed on Bryant Streett particularly from Colorado Avenue to Oregon Expressway. A 4-way stop intersection at this location is expected to provide some relief to these problems. VI. New Mayfield Lane/Mimosa Lane There is presently no right-of-way control at this intersection. There have been three accidents at this location during a five year period. It is apparent that serious visibility restrictions are imposed at the intersection by surrounding buildings. 'lbe designation of Mimosa Lane as a through street at this location is expected to help resolve this situation. VII. Mesa/oak No vehicular right-of-way contro.l exists at this intersection. A neighborhood petition from this area suggests that a potential h8%ardous condition exists at this intersection, Inadequate sight distances and the lac.k of sidewalks or pathways for pedestrians substantiate the need for a 3-way stop intersection. This action will improve pedestrian safety ct:>nditions and thereby reduce the potential for pedestrian/vehicle accidents at this location. VIII. Dcnald/Maybell Donald/Georgia Georgia/Hubbart Georgia/Crosby Residents of the Greenacres II neighborhood have reported extremely serious C'oncerns about reckless driv-..:..ag and speeding prevalent in the neighborhood, particularly on Donald Drive and Georgia Avenue. 'nle residents believe that as an interim immediate action plan. the installation of 3-way stop Page 2 of 3 . . . • • • intersections at the above locations coupled with eventual roadway channeli- zation at strategic locations :will at least help ameliorate the problems, if not resolve them entirely. Although the four 3-way stop intersections do not appear to be necessary solely on the basis of recorded accident history and/or for reason of vehicular right-of-way assignment, the staff believes that such new stop intersections are supportable as an interim solution pending the development of comprehensive long-range solutions for the neighborhood traffic problems and concems. IX. Louis/Amarillo Louis/Elbridge Louis/Greer Similar to the resident complaints and concerns registered in the Greenacrea II neighborhood, some residents of Louis Road have registered frequent complaints and concerns about th~ traffic speeds on Louis Road. In addition, official school crossings of Louis Road exist at Amarillo Avenue, Elbridge Way and immediately·north of Greer Road. Although neither the recorded accident history alone nor the school crossing protection warrants and policies adopted by the Council in early 1973 alone appear to justify the three new stop intersection locations, it is the staff's view that the combination of both coupled with the concerns raised by residents of Louis Road provide a relatively sound basis for such action.
