HomeMy WebLinkAboutRESO 4964' 4 •• • ., • ORIGINAL RESOLUTION NO, 4964 - RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING A MISCELLANEOUS DIVISION OF LAND FOR PROPERTY LOCATED ON LOS TRANCOS ROAD NEAR ALPINE ROAD IN THE CITY OF PALO ALTO AND GRANTING AN EXCEPTION FOR LOT AREA ON ONE PARCEL, SUBJECT TO CONDITIONS WHEREAS, 29.44 acres of property zoned o-s located on the easterly side of Los Trancos Road approximately one-half mile from its intersection with Alpine Road in the City of Palo Alto, being a portion of Rancho El Corte de Madera and identified as Assessor's Parcel No. 182-36-009, hereinafter referred to as the "subject property," is proposed to be divided into three parcels; and WHEREAS, the proposal will create three parcels, Parcel 1 and Parcel 3 consisting of 10 acres each and Parcel 2 consisting of 9.4 acres; and WHEREAS, Parcel 2 is a rear lot which is required by Section 21.32.0SO(b) of the Palo Alto Municipal Code to have an area which exceeds the 10-acre lot area requirement of the o-s District by 20 percent exclusive of any access to a public street; and WHEREAS, Parcel 2 therefore is substandard in area by 0.6 acres under o-s District regulations and by 2.6 acres under rear lot regulations, requiring an exception from the requirements of Section 21~32.0SO(b) of the Palo Alto Municipal Code; NOW, THEREFORE, the council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Council finds that there are special condi- tions affecting Parcel 2 due to tJ:le dimensions and geometry of the parcel, that the exception granted herein is necessary for the preservation and enjoyment of a substanti~l property right ..... ... . .., • of the petitioner; and that the exception granted herein will not be detrimental to the public welfare or injurious to other property in the territory in which this property is situated. SECT!ON 2o The Council hereby approves a miscellaneous division of land into three parcels, designated as Parcel 1, Parcel 2, and Parcel 3, for the subject property, as shown on the map attached her~to and incorporated herein by reference, and grants the exception to the area requirements of Section 21.32.0SO(b) of the Palo Alto Municipal Code for Parcel 2, sub- ject to the following conoitions: 1. Access from Los 'Trancos Road must be capable of supporting 33,000 pounds of fire apparatus during all weather, must have a 20-foot paved surface, must have a clear 13-foot overhead clearance, must have an incline not in excess of 15 percent, and must meet the vertical and horizontal curves established for fire apparatus. 2. The developer shall pay all extension charges to each parcel to Pacific Gas and El~ctric Company unless Pacific Gas and Electric •:ompany refuses to serveo Then the developer shall pay extension charges per City Schedule E-So 3. The developer shall apply to the County of Santa Clara Health Department for approval of septic systems installationso 4e A preliminary soils report shall be submi~ted prior to approval of the final mapo Attention is called to Section 180710140 of the Palo Alto Municipal Code requiring an in-depth geological soils investigation for site and design approvale s. The developer shall construct a drainage oystem along the proposed 30-foot road within the subject property subject to the approval of the City Engineero 6. The owner of Parcel l shall have the option to acquire the right of inqress and egress along the proposed 30-foot access road in the event he or she wishes to build near the northerly end of Parcel 1 .. 7. Cut and fill slopes shall not exceed one and one-half horizontal to one vertical~ All slopes shall be protected with native plants to prevent erosiono -2- . ~ .. .. • • 8. The developer shall submit an offer of dedica- tion to the City of Palo Alto for road purposes a strip of land 60 feet wide lying equally on each side of the existing centerline of Los Trances Road as such road or any part thereof falls within the limits of the subject property. 9, The developer shall pay in full or segregate Assessment No, 18, Bond Series E, Foothill Gas system, 10. Water shall be provided by the developer suffi- cient for fire flow capacityo SECTION 3.
