HomeMy WebLinkAboutRESO 9579160216 jb 0131507 1 February 2016 Resolution No. 9579 Resolution of the Council of the City of Palo Alto Amending the Fiscal Year 2017 Municipal Fee Schedule for Cost of Services Fee Increases and Hourly Adjustments For Planning Entitlements and Related Services R E C I T A L S A. The Department of Planning & Community Environment charges user fees to applicants requesting planning entitlements and related services. B. While these fees have been annually adjusted across the board based on inflation factors, it has been at least five years since they have been subject to a full evaluation based on the cost of providing services. C. In 2015, the City performed a Cost of Service Study to evaluate whether the full cost of providing services. As a result of the Cost of Service Study the City desires to modify some of the PCE fees. D. In accordance with the provisions of Chapter 8 of Division 1, of Title 7, commencing with Section 66016 of the Government Code, as applicable, the Council did on March 28, 2016, hold a public hearing on the proposed amendments to the Municipal Fee Schedule, after publication of notice and after availability of the data supporting the amendments was made available to the public at least 10 days prior to the hearing. NOW, THEREFORE, the Council of the City of Palo Alto RESOLVES as follows: SECTION 1. The Council of the City of Palo Alto adopts the changes to the Municipal Fee Schedule as set forth in Exhibit "A" . When effective, such fees shall supersede any prior inconsistent fees charged by the Planning and Community Environment Department. SECTION 2. The amount of the new or increased fees and charges is no more than necessary to cover the reasonable costs of the governmental activity, and the manner in which those costs are allocated to a payer bears a fair and reasonable relationship to the payer's burden on, or benefits received from, the governmental activity. SECTION 3. Fees in the Municipal Fee Schedule are for government services provided directly to the payor that are not provided to those not charged. The amount of this fee does not exceed the reasonable costs to the City of providing the services. Consequently, pursuant to Art. XIII C, Section l(e)(2), such fees are not a tax. SECTION 4. Effective Date. Pursuant to Government Code Section 66017, all Planning Department fees relating to a "development project" as defined in Government Code Section 66000 shall become effective no sooner than sixty (60) days from the date of adoption. The fees increases proposed for FY 2018 described in Exhibit A shall go into effect on July 1, 2017. SECTION 5. CEQA. The Council of the City of Palo Alto hereby finds that this is not a project under the California Environmental Quality Act and, therefore, no environmental impact assessment is necessary.
