Monday, October 3, 1988
The City Council of the City of Palo Alto met on this date
in the Council Chambers, 250 Hamilton Avenue, at 7:37 p.m.
PRESENT: Bechtel, Cobb, Klein, Levy, Patitucci,
Renzel, Sutorius, Woolley
ABSENT: Fletcher
Mayor Sutorius announced, upon conclusion of the regular
meeting, the Council would immediately adjourn to a study
session in the Council Conference Room to discuss Regional
Water Quality Control Plant operations.
ORAL COMMUNICATIONS
Ben Bailey, 171 Everett, spoke regarding complaints against
the Palo Alto Police Department and the City's lack of
responsiveness to his inquiries regarding disciplinary
actions. He referred to Risk Manager Don West as legal
counsel to the City of Palo Alto.
City Manager Bill Zaner noted for the record that Risk
Manager Don West was not paid legal counsel for the City of
Palo cal Lo.
Harrison Otis, 2721 Midtown Street, spoke regarding the
plight of the homeless.

10. PUBLIC HEARING: Planning Commission recommendation re
application by Steven Carlitz and Ronald Dunn for a
nine -unit residential condominium subdivision for

City Attorney Diane Northway referred to the memo, page
three, under Findings. There was an error in the designa-
tion of the program of the housing element, which related
to the BMR program. Finding No. 2 should have read Program
9 instead of Program 19.
Council Member Cobb pointed out there were no "guest"
parking spaces available since it would be illegal to park
in the handicapped zones, which were identified as "Handi-
capped/Guest.'
MOTION: Vice Mayor 1lein moved, seconded by Sutorius,
approval of tentative subdivision rep, subject to the
conditions stated on page three of the development report,
as follows:
FINDINGS
1. The subdivision will not have a significant effect on
the environment, as demonstrated in the attached nega-
tive declaration.

2. In accordance with Palo Alto Municipal Code (PARC),
Section 21.12.090(b), the proposed subdivision as
conditioned, together with the provisions for its
design and improvement, complies and is consistent with
i'ie provisions of State law and the PARC, includi g
that the site is physically suitable for the type and
density of the proposed development, there are no
conflicts with public easements and one BMR unit will
be provided in compliance with the provisions of
Program 9 of the Housing Element of the Palo Alto
Comprehensive Plan.
COWDITIGNS
1. The developer shall apply for a `Tract Number' from the
County Assessor's Office;
2. the Final hap must be filed within 24 months after City
Council approval of the tentative map, or the tentative
map approval will expire.
3. Retain the three Sycamore trees adjacent to the prop-
erty on Alma Street.
4 A recorded five-foot wide drainage easement, as shown
on the preliminary drainar.-s plans, must be submitted
with the final map and approved by the Public Works
Department prior to submitting an application for a
building permit;
5. The project must return to City Council if there is a
change in the grade differential of one foot, or
greater, in height from the neighboring sites.
6. The BRR /Letter agreement from Ken Schreiber dated
July 29, 1988 shall be incorporated into the
subdivision agreement.
7. A bond to the City will be required to guarantee aIx
improvements within the City right-of-way. This will
include storm drainage, sidewalk and other related
street improvements. Developer will be responsible for
submitting an engineer's estimate of these
improvements.

11. PUBLIC HEARING: Planning Commission recommendation
re application by BW Construction for a 32 -unit
residential condominium subdivision for property
located at 800 North Charleston Avenue. (300)
Mayor Sutorius declared the Public Hearing open.
Sandra Friedman, 792 E. Charleston, lived adjacent to the
property under discussion. She would like to have been
notified before all the decisions had been made since her
property would be greatly affected by the condominium
subdivision due to added noise and elimination of privacy
in her patio area. She understood that what was going on
was within code, and hoped the project wculd go well so
she would not have to return to Council with more concerns.
Mayor Sutorius assured Ms, Friedman the review process was
such that what was approved would be built.
Mayor Sutorius declared the Public Hearing closed.
Council Member Cobb queried staff about the concerns of
Ms. Friedman regarding privacy and landscaping and whether
they were properly covered in the memo.
Chief Planning Official Carol Jansen replied Mr. Fr.i.edman's
concerns were covered in the memo and Jim Reuben of BMW
Construction had worked out a special_ planting program for
each of _he abutting neighbors. The project was not to be
finalized until the plantings were in place as well as an
eight -foot fence between the properties, instead of a
six-foot fence.
NOTION: Council Member Cobb moved, seconded by Woolley,
approval of the Planning Commission's recommendation
regarding the tentative subdivision map subject to the
following conditions:
FINDINGS
1. The subdivision is within the scope of the project
covered by the program Environmental Impact Report
(EIR) which the City of Palo Alto prepared for the San
Antonio Road/West Sayshore CS/Gl Zone Study and no new
environmental document for the subdivision is required
because, pure ant to Section .15162 of the Guidelines
for the California Environmental Quality Act, no new
significant environmental impacts not considered in the
EIR would result from the subdivision.

2. In accordance with Palo Alto Municipal Code (PARC),

conditioned, together with the provisions for its
design and improvement, complies and is consistent with
the provisions of State law and the PAMC, including
Sections 66473.5 and 66474 of the Government Code, in
that the site is physically suitable for the type and
density of the proposed development, there are no
conflicts with public easements and two BMR units will
be provided in compliance with the provisions of
Program 12 of the Housing Element of the Palo Alto with
Comprehensive Plan.
CONDITIONS
1. The Developer shall apply for a 1°Tract Number° from the
County Assessor's Office.
2. A Final Map must be filed 24 months after City Council
approval of the tentative map or the tentative map
aprroval will expire.
3. The provisions of the letter of agreement from Ken
Schreiber dated September 6, 1988 shall be incorporated
into the Subdivision Agreement prior to recordation of
the Final Map.
4. The emergency access at Charleston Road shall be
reviewed by the Fire and Police Departments, prior to
issuance of a Suild4ng Permit, to ensure that the land-
scaping and method of securing the access from regular
traffic complies with City raquirewents.
Council Member Renzel was concerned about the 20 -foot right
of way and hoped Council would watch for that in any
remaining parcels to be developed.

12. PUBLIC HEARING: Planning Commission recommendation re
application by Hal Long for a subdivision modification
for the addition of one Below Market Rate residential
condominium unit to an existing nine -unit condoaniaium
building located at 744 Ramona/225 Homer Avenue. (300)
Mayor Sutorius declared the Public Hearing open. Receiving
no requests frog the public to speak, he declared the
Public Heating closed.

MOTION: Council Member Petttucci moved, seconded by
Klein, approval of the Planning Commission's recommendation
regarding the tentative subdivision motp, subject to condi-
tions stated below:
FINDINGS
1. The subdivision will not have a significant effect on
the environment, as demonstrated in the attached nega-
tive declaration.
2. In accordance with Palo Alto Municipal Code (PAMC),
Section 21.12.090(b), the proposed subdivision as
conditioned, together with the provisions for its
design and improvement, complies and is consistent with
the provisions of the Subdivision Map Act, Title 21, of
the PAMC, the Palo Alto Comprehensive Plan and all
other provisions of State law and the PAMC, including
Sections 66473.5 and 66474 of the Government Code, in
that the site is physically suitable for the type and
density of the proposed development, there are no
conflicts with public easements and one BMR unit will
be provided in compliance with the provisions of
Program 12 of the Housing Element of the Palo Alto
Comprehensive Plan.
CONDITIONS

Applicant shall submit a building permit application
showing revisions to the storage area, and the revised
bicycle parking, for approval prior to occupancy of the
tenth dwelling unit.
2. Applicant shall submit a Final Map application with
revised condominium plan for approval prior to
recording.
3. The provisions of the letter of agreement from Ken
Schreiber dated August 11, 1988 shall be incorporated
in the Subdivision Agreement.
MOTION PASSED unanimously, Fletcher absent.
13. PUBLIC HEARING: Planning Commission recommendation re
minor amendments to the Cottage Ordinance (23!"
Council Member Fenzel queried Planning Department staff
regarding. the necessity of adding language to ensure the
17 -foot height requirement for a pitched roof.

Mayor Sutorius declared the Public Hearing open.
Ms. Jansen said the amendments to the Cottage Ordinance
would require architectural compatibility and the 17 -foot
requirement would allow for only one floor.
Harrison Otis, 2721 Midtown Court, said he believed Council
was going in the right direction by imposing a 17 -foot
height limitation.
Mayor Sutorius declared the Public Hearing closed.
MOTION: Council Member Renzel moved, seconded by
Pa titucci, approval of the Planning Commission's recom-
mendation regarding potential ordinance revisions
considered by the Planning Commission Subcommittee studying
the R--1 zoning regulations. These revisions could be
incorporated into the comprehensive R-1 ordinance changes
and would help to reduce the impact of new cottage con-
struction on single-family neighborhood characters
1. The cottage shall be served off of a common driveway
with the main residence in order to prevent new curb
cuts, excessive paving and street tree elimination;
2. The cottage shall be architecturally compatible with
main residence, and the additional parking shall be
screened to off -site views with vegetation or fencing;
3. The design of the cottage shall permit usable outdoor
living area for both the grain residence and the
cottage, whether or not that outdoor area is in common;
and
4. The maximum: height of a cottage shall be reduced to 17
feet, consistent with the new standard applied to Flag
Lots through the interim regulations governing develop-
ment an flag lots.

14. PUBLIC HEARING: Planning Commission and Architectural
Review Board recommendation re application by the City
i of Palo Alto for Site and Design approval of the Refuse
Area Administration Center.) Truck Scale and Toll Booth,
for property located at 2360 Embarcadero Road. (300)
Council Member Levy said Council Member Fletcher ttad
inquired about bicycle parking because she did not see any
provision for bike racks or covered parking.

Deputy Director, Public Works Operations, Mike Miller said
the department would work with the Planning Department and
include bike lockers or racks.
Council Member Renzel asked how many female employees there
were at the Pefuse Area, and whether any female employees
would be involved in the operation of the sump in the
future. She was concerned with the size of the women's
restroom area compared to the men's.
Mr. Miller said there was currently one female employee at
the Refuse Area, but they anticipated hiring more females
as openings became available. He also indicated there
would be enough room to enlarge the women's restroom area
to include showers.
NOTION: Council Member Levy moved, seconded by Renzel,
to approve the Planning Commission recommendation regarding
tha Style and Design of the Refuse Area Administra=tion
Center, subject to the findings and conditions listed
below, with an additional Lecoeeendation to provide bicycle
racks as appropriate and to provide covered area for two
bicycles:
FINDINGS
1. That the project will not have any significant environ-
mental impacts, in that the installation and operation
of the new facilities will cause minimal disruption of
the site and will not create any increased impact an
adjacent areas.
2. That the proposed design will be orderly, harmonious
and compatible with existing or potential uses of
adjoining property, in that the proposed improvements
will support existing and proposed uses on the sits and
the pry ject has been designed to blend with the natural
environment. This will be accomplished by locating the
trailer on the south side of an existing mound and by
using materials and colors which blend with the natural
surroundings, such as wood siding and earth tone
colors.
3. The project will maintain desirability of i vestment in
the saaee or adjacent areas„ in that it will allow the
landfill to be operated more efficiently and will
promote effective planning and more eccuraato prediction
of future landfill use, thus promoting the planned
conversion of the landfill to a public park.

4. The proposed design will observe sound principles of
environmental design and ecological balance by locating
outside sensitive plant and animal habitat areas.
5. 1'he propcf med use would be in accord with the Palo Alto
Comprehensive P mn, in that the proposed use and
related improvements help to carry out the stated
objective of the Baylands Master Plan to convert the
landfill to park use.
CONDITIONS
1. That design and landscaping in the access road and
entrance to the Recycle Center and Landfill Facility be
incorporated into the design of Byzbee Park, Phase I.
2. That the landscaping at the Recycle Center be expanded
to include climbing vines planted along the north and
east side, of the facility.
3. That exterior materials, colors and design details be
approved by the Arcili tectural Review Board (ARB) prior
to building permit issuance.

15. Water Usage and Conservation Update (1410-02)
City Manager Bill Zaner said city conservation efforts were
at approximately 17.5 percent and wells were delivering
about 34 percent of the water being used. The City was
slightly more than 18 percent helow San Francisco's allo-
cation. Some of the wells were being shut. down.
No action taken.

Water Quality Control Plant Operations in the Council
Conference Room at 8:33 p.m.
Mayor Sutorius opened the Study Session and noted
October 7F 1988 was the deadline for the Regional Water
Quality Control Board to receive input on the draft permit.

Direc*or of Utilities Richard Young introduced the Manager
of Water Quality Control, John Gibbs, who made the formal
presentation of the three topics. The first was an outline
of Present plant operations and the successful meeting of
existing requirements and limits on metals toxics, and
biological considerations.
The second was a description of the Pretreatment Program as
applied to specific industrial customers and sources of
contaminated groundwater, potential modifications to expand
the program for source reduction activities which would
require additional staff, estimates of small quantity
generators and the predominant chemicals produced at such
facilities,and the household toxics problem. The latter.
lead to comments regarding specific content of certain
metals contained in common household cleaning products.
The last major topic way a discussion of the draft permit.
This document was part of the staff reports supplied for
use during the Study Session (CMR:435:8 and CMR:465:8) and
reflected changes proposed for metals limitations, and
added ammonia limits. It proposed increasing monitoring
requirements by a factor of four on metals, added new
studies for quality assurance and quality control, minimi-
zation plans, and various toxicity tests. New testing
would require weekly analysis for metals, adding selenium
and polyaromatic hydrocarbons. It also contained require-
ments for placing and testing tissue contents of mussels,
analysis of bay water metals and sediments.
Overhead charts were presented showing the Service area for
the plant, performance (removal levels), metals limits
versus actual discharge, metale in clams, the fresh water
marsh proposal, comparison of metals in various sources,
the pretreatment program monitored dischargers, groundwater
discharge permits, pretreatment section organization,
metals limits changes, bay basin plan alternatives, metals
reduction alternatives, metals origin percent by city, and
draft permit study and monitoring requirements.
Council asked questions of staff and asked for comments
from Bruce Baines of Los Altos and Mark Harris of Mountain
View. Mr. Harris reported some contact with industrial
customers who felt the target was shifting after ,they put
considerable effort into their facilities. Trish Mulvey
spoke expressing the concerns of Citizens for a Better
Environment and the Audobon Society.
