RESOLUTION OP THE COUNCIL OF THE CITY OP PALO ALTO
AUTH(»tIZING THE CITY MANAGER OR THE ASSISTANT CITY
HANAGER TO EXECUTE RIGHT OP NAY CERTIPICATIOHS FOR CERTAIN COmTRUCTION PIMJECTS
WHEREAS, under certain Federal and State requireaents the
contract for conetruction of a project where real estate ri^ts of
way Bust be acquired cannot be awarded until the necessary rights
of way have been secured; and
WHEREAS, prior to advertising for bids on any such project
that it adainisters, the State of California Departswnt of
Transportation (Caltrans) requires the subeission of evidence, in
the fora of an executed Right of Hay Certification, that the
necessary rights of way are available for construction purposes;
NON, THEREFORE, the Council of the City of Palo Alto does
hereby RESOLVE as follows:
SECTION 1. The City Council hereby authorizes either the
City Manager or the Assistant City Manager of the City of Palo Alto
to execute in the naae of, and for and on behalf of, the City of
Palo Alto any Right of Way Certifications in connection with
construction projects when such certifications are required by
Caltrans or any other public agency.
SECTION 2. The City Council hereby finds that the passage
of this resolution is not a project under the California
Environiaental Quality Act and, therefore, no environsental iapact
assesssent is necessary.
