HomeMy WebLinkAboutRESO7289RESOLUTION NO. 7289 RESOLUTION OF THE COUNCIL OF THE CITY ADOPTING AND AU'T'HORIZING EXECUTION SUPPLEMENT NG.. 005 TO THE AGREEMENT CITY OF PALO ALTO AND CALTRANS FOR PROJECTS, RELATING TO THE PROPOSED BRIDGE AND BIKE PATH EXTENSION OF PALO ALTO OF PROGRAM BETWEEN THE FEDERAL -AID EMBARCADERO PROJECT WHEREAS, the City of Palo Alto and the California Department of Transportation ("Caltrans") have entered into an agreement entitled "Local Agency -State Agreement for Federal -Aid Projects," No. 04-5100, dated April 10, 1977 (the "Master Agreement"); and WHEREAS, the Master Agreement sets forth the general terms and conditions under which all federal aid projects shall be performed, but provides that terms and conditions for each specific federal aid project shall be set out in a "Supplemental Local Agency -State Agreement," also referred to as a "program supplement," which is adopted by the City and approved by Caltrans; and WHEREAS, the City has requested federal funds to finance preliminary engineering studies for the proposed Embarcadero Bridge and Bike Path Extension project (the "project") , which requires the City Council to adopt a program supplement (No. 005) for the project; and WHEREAS, the City Council desires that preliminary engineering studies be done relative to the project, and to adopt Program Supplement No. 5. NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Council hereby adopts Program Supplement No. 005 to the Master Agreement between the City and Caltrans, and authorizes the Mayor to execute said Program Supplement for and oil behalf of the City of Palo Aito. SECTION 2. Adoption of the Program Supplement does not constitute a project. for purposes of the California Environmental Quality Act ("CEQA"); however, the proposed Embarcadero Bridge and Bike Path Extension project would be considered a project under 1 940x207 lac 0030874 s APPROVED AS TO FORM: CEQA, and an environmental assessment would be required prior to City review of that pro}ect.
