RESOLUTION OF 1HE COUNCIL OF TFE CITY OF PALO ALTO ORDERING
THE SUMMARY VACATION OF N. PUBLIC SERVICE EASEMENT FOR INGRESS & EGRESS
AT PARCEL NUMBERS 063-540-270, 063-540-280, 063-540-280
IN THE CITY OF EAST PALO ALTO
WHEREAS, the public service easement for ingress •and egress located at parcel
numbers 063-540-270, .63-540-280, 063-54028C in East Palo Alto, has not been
utilized in over five (5) consecutive years and• is not necessary for future
public use; and
WHEREAS, from all evidence submitted to the Council of the City of Palo Alto
J.t is found that the public service easement as described herein is not
necessary for present or prospective public use for public.service purposes;
and
WHEREAS, it is the intent of the Council of the City of Palo Alto to vacate
the public service easement, recorded April 15, 1946, in Vol. 1269 of
Official Records at oage 315, Records of San Mateo County, California;and
WHEREAS, the Council of the City of Palo Alto intends to vacate such public
service easement according to the procedures set forth in the California
Streets and Highways Code Division 9, Part 3, Chapter 4 (Section 8333 et
seq.);
NOW, THEREFORE.; the Council of the City of Palo Alto does RESOLVE as fellows:
SECTION 1. This vacation is made under the authority of California Streets
and Highways Code Chapter 4 of Part 3 of Division 9, commencing at section
8330.

SECTION 2. The twenty-five (25) foot public service easement located at
parcel numbers 063-540-2.70, 063-540-280, 063-540-280 in East Palo Alto is
hereby vacated. The easement is more particularly described in Exhibit A and
shown in Fxhibit B, which Exhibits are attached hereto and incorporated
herein by this reference.
SECTION -3. The Council finds that the easement has not been utilized in over
five (5) consecutive years and is not necessary for future public use.
SECTION 4. This Council finds that this project is categorically exempt from
the requirements of the California Environmental Quality Act and no
environmental impact assessment is necessary.
SECT3'ON 5. The City Clerk, acting through the Real Property Manager, shall
cause a certified copy of this resolution attested by the City Clerk under
seal to be recorded in the Office of the County Recorder of :'anta Clara.
SECTION 6. From and after the date of recordation of this resolution, this
easement shall be ;onsidered vacated.

LLGAL DESCRIPTION
EASEMENT VACATION
PARCEL 1
A portion of the Pulgas Rancho and a portion of Swamp and
Overflowed Lands Survey No. 24 and a portion of Lot 2 of Section
31, Township 5 South, Range 2 West, M.D.B. & M. described as a
whole as follows:
Being a strip of land 25 feet wide, the centerline thereof
described as follows;
Beginning at a point on the Northeasterly line of U.S. Highway No.
101 alternate, Section D., Route 68, District 4 in San Mateo County
California commonly known as the Bayshore Highway which said Point
of Beginning is North 53° 45' West (called North 53° 39' West on
the plans for said Highway) along, said Highway line a distance of
95.43 feet from its intersection with the dividing line between San
Mateo and Santa Clara Counties;
THENCE North 50 28' 00" East 431.69 feet;
THENCE North 56° 42' 30" East 89.62 feet;
THENCE North 64° 16' 30" East 85.62 feet;
THENCE South 73° 50' 00" East 19.43 feet to the terminus of said
easement, said terminus lying on the most westerly line of Lot 22,
in Block 30, as said Lot and Block are shown on map entitled "Palo
Alto Gardens Map No. 3", recorded June 22, 1951 in Volume 33 of
Maps at Page 33 in the office of the County Recorder San Mateo
County, State of California.
Said easement is shown on attached map "EXHIBIT E" and made a part
hereof.
Containing 15689 square feet more or less.
