TLties 1 / Pages 22 Fees - No Fees Taxes Copies AMT PAID BRENDA DAVIS SANTA CLARA COUNTY RECORDER Recorded at the request of Cit, RDE a 008 9/24/1997 3 05 PM RESOLUTION NO. 7657 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ORDERING VACATION OF PUBLIC STREET AND UTILITIES EASEMENTS ON THE PALO ALTO MEDICAL FOUNDATION DEVELOPMENT SITE AT 795 EL CAMINO REAL WHEREAS, the Palo Alto Medical Foundation for Health Care, Research, and Education ("PAMF") has petitioned the City of Palo Alto (the "City") to vacate certain public street and utilities easements; and WHEREAS, PAMF has requested that the streets and utilities easements be vacated because PAMF desires to construct a new medical facility ("Project") on the property currently traversed by the described public streets and easements, and the City Council approved the Project on January 29, 1996; and WHEREAS, the Project includes dedication of new public rights -of -way and easements as necessary to serve the Project and properties in the vicinity thereof; and WHEREAS, the Environmental Impact Report prepared for the Project concludes that replacement of the existing street pattern with the proposed new public streets, including an -extension of Urban Lane, would improve circulation in the vicinity of the Project site, which would benefit the general public; and WHEREAS, on January 29, 1996, the City Council adopted Resolution No. 7572, declaring its intent to vacate the streets and utilities easements according to the procedures set forth in City Policy and Procedure 1-13 and California Streets and Highways Code Section 8320 et seq., and setting a public hearing thereon for February 20, 1996, or as soon thereafter as the matter could be heard; and WHEREAS, at the request of PAMF, the public hearing was duly continued from time to time, to coincide with the public hearing on the tentative subdivision reap which will provide for 1 970313 44 0080332 • • substitute access as required by Resolution No. 7572, and has been renoticed for hearing on March 24, 1997; and WHEREAS, the City Council finds that notice of the proposed vacation, stating the purpose of said resolution and the time and place set for the public hearing, was posted as required by law; NOW, THEREFORE, the Council of the City of Palo Alto does hereby RESOLVE as follows: SECTION 1. The City Council hereby finds, based upon the evidence submitted to the Council at the public hearing held on March 24, 1997, and the public record with respect co the Project, all of which evidence is hereby incorporated by reference into these findings, that: A. The environmental impacts of the Project, including the proposed vacation, have been analyzed in an Environmental Impact Report ("EIR"), which was certified as adequate by the City Council on January 29, 1996, by adoption of Resolution No. 7569. The resolution also made the findings required pursuant to the California Environmental Quality Act (Public Resources Code section 21000 et seq.) prior to approval of the Project. B. The streets and public utilities easements being vacated are not necessary for present or prospective public use, in that the Project includes dedication of new public rights -of -way and easements as necessary to serve the project and properties in the vicinity. C. As identified in the EIR, replacement of the existing street pattern with the proposed new public streets, including extension of Urban Lane, will improve circulation in the vicinity of the Project site, resulting in benefit to the public. SECTION 2. The City Council, under the authority of City Policy and Procedure 1-13 and California Streets and Highways Code Section 8320 et seq., hereby orders that the streets and public utilities easements, as depicted on the attached Exhibit "A," and as more particularly described in Exhibit "B" and shown on Exhibit 'C: be vacated. SECTION 3. The vacation ordered under Section 2 hereof is expressly conditioned as follows: The vacation will occur only after PAMF has granted the City all necessary new streets and easements as shown on the tentative subdivision map approved by the City Council for the PAMF project, and as required by conditions of the tentative subdivision map approval. // 1/ // // // // 2 970313 lac 0080332 SECTION 4. The City Council hereby orders the City Clerk, acting through the City Real Property Manager, to cause a certified copy of this Resolution to be recorded in the Office of the County Recorder of Santa Clara following approval by the City Council of the final subdivision map for the Project. From and after the date of such recordation, the streets and easements shall be considered vacated.
