No.: 142-2-1, 2, 3, 4 & 5 PARCEL No.: CE 26/lthrough 8 -0115 PROJECT: Vacation of public utility & roadway easements -Stanford Sand Hill Rd. project SUMMARY VACATION RESOLUTION No. 8143 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ORDERING THE SUMMARY VACATION OF PUBLIC UTILITIES AND ROADWAY EASEMENTS ALONG SAND HILL ROAD, PASTEUR DRIVE, ARBORETUM DRIVE, AND QUARRY ROAD, AND A PUBLIC UTILITIES EASEMENT NEAR HOOVER PAVILION IN THE CITY OF PALO ALTO WHEREAS, public service easements for utilities and roadways located along Sand Hill Road, Pasteur Drive, Arboretum Drive and Quarry Road, and a public service easement for utilities near Hoover Pavilion in the City of Palo Alto have been relocated and are not necessary for future public use; and WHEREAS, from all evidence submitted to the Council of the City of Palo Alto, it is foun<;l that said public service easements as described herein are not necessary for present or prospective public use for public utility purposes; and WHEREAS, it is the intent of the Council of the City of Palo Alto to vacate the public service easements for utilities and roadways described as follows: 1. · Parcels 1, 2, 5, 6 and 7 as described in the Easement Agreement, recorded as Document No.14211545, Official Records of Santa Clara County, State of California, on June 1, 1998, as such parcels are shown in Exhibit A attached hereto and made a part hereof by this reference; .1 2. Parcel "B" as described in that certain City of Palo Alto Easement for Street and Roadway purposes, recorded August 4, 1959 irt Book 4519 of Official Records of Santa Clara County at Page 413; 3. A portion of Parcel "A", as described in the Easement Deed recorded August 4, 1959 in Book 4519 of Official Records of Santa Clara County at Page 413, which portion is described in Exhibit B-1 and shown in Exhibit B-2 attached hereto and by this reference incorporated herein; 4. A portion of the lands described in the Easement Deed recorded February 13, 1957 in Book 3729 of Official Records of Santa Clara County at Page 7, which portion is described in Exhibit C-1 and shown in Exhibit C-2 attached hereto and by this reference incorporated herein. 5. Parcels "A" and "B" as described in that certain City of Palo Alto Easement for street and roadway purposes, recorded November 6, 1969 in Book 8730 of Official Records of Santa Clara County at Page 559; 6. Parcels "A" and "B" as described in that certain City of Palo Alto Easement for street and roadway purposes, recorded April 11, 1955 in Book 3148 of Official Records of Santa Clara County at Page 395; 7. Parcel No. 1 as described in that certain City of Palo Alto Easement for street and roadway purposes recorded January 15, 1960 in Book 4666 of Official Records of Santa Clara County at Page 474; 8. City of Palo Alto Easement for street and roadway purposes recorded February 16, 1972 in Book 9705 of Official Records of Santa Clara County at Page 738; . 9. Parcels "B" and "D" as described in that certain City of Palo Alto Easement for street and roadway and public utility purposes, recorded December 30, 1987 in Book K406 of Official Records of Santa Clara County at Page 482; and . WHEREAS, the Council of the City of Palo Alto intends to vacate such public service easements for utilities according to the procedures set forth in the California Streets and Highways Code Division 9, part 3, Chapter 4 (Section 8330 et.seq.); NOW, THEREFORE, the City council does hereby RESOLVE as follows: SECTION 1. This vacation is made under the authority of California Streets and Highways Code Chapter 4 of part 3 of Division 9, commencing at Section 8330 et. seq. · SECTION 2. The public service easements for utilities and roadways described as follows are hereby vacated: 2 ,, 1. Parcels l, 2, 5, 6 and 7 as described in the Easement Agreement, recorded as Document No.14211545, Official Records of Santa Clara County, State of California, on June 1, 1998, as such parcels are shown in Exhibit A attached hereto and made a part hereof by this reference; · 2. Parcel "B" as described in that certain City of Palo Alto Easement for Street and Roadway purposes, recorded August 4, 1959 in Book 4519 of Official Records of Santa Clara County at Page 413; 3. A portion of Parcel "A", as described in the Easement Deed recorded August 4, 1959 in Book 4519 of Official Records of Santa Clara County at Page 413, which portion is described in Exhibit B-1 and shown in Exhibit B-2 attached hereto and by this reference incorporated herein; 4. A portion of the lands described in the Easement Deed recorded February 13, 1957 in Book 3729 of Official Records of Santa Clara County at Page 7, which portion is described in Exhibit C-1 and shown in Exhibit C-2 attached hereto and by this reference incorporated herein. 5. Parcels "A" and "B" as described in that certain City of Palo Alto Easement for street and roadway purposes, recorded November 6, 1969 in Book 8730 of Official Records of Santa Clara County at Page 559; 6. Parcels "A" and "B" as described in that certain City of Palo Alto Easement for street and roadway purposes, recorded April 11, 1955 in Book 3148 of Official Records of Santa Clara County at Page 395; 7. Parcel No. 1 as described. in that certain City of Palo Alto Easement for street and roadway purposes recorded January 15, 1960 in Book 4666 of Official Records of Santa Clara County at Page 474; 8. City of Palo Alto Easement for street and roadway purposes recorded February 16, 1972 in Book 9705 of Official Records of Santa Clara County at Page 738; 9. · Parcels "B" and "D" as described in that certain City of Palo Alto Easement for street and roadway and public utility purposes, recorded December 30, 1987 in Book K406 of Official Records of Santa Clara County at Page 482; SECTION 3. The Council finds that the public service easements for utilities have been reloci;t_ted and are not necessary f~r future public use. SECTION 4. The Council finds that the action approved herein is part of the Sand Hill Road Project(s) for which the Council certified an Environmental Impact Report pursuant to its adoption of Resolution No. 7685. 3 SECTION 5. The City Clerk, acting by and through the Real Property Manager, shall cause a certified copy of this resolution, attested by the City Clerk under seal, to be recorded without acknowledgment, certificate of acknowledgem,ent or further proof thereof, in the Office of the Recorder of Sa11ta Clara County. SECTION 6. From and after the date of recordatfon of this resolution, those public service easements described in Section 2 of this resolution shall be considered vacated.
