RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING THE LAND USE MAP OF THE PALO ALTO
COMPREHENSIVE PLAN FOR THE AREA GENERALLY BOUNDED
BY WAVERLEY STREET, HOMER AVENUE, RAMONA STREET,
AND CHANNING AVENUE (SOUTH OF FOREST AVENUE
COORDINATED AREA PLAN PHASE I) AND REVISING THE
NON-RESIDENTIAL DEVELOPMENT AND DOWNTOWN
DEVELOPMENT CAP AREAS TO INCLUDE THE MIXED USE
DISTRICT OF SOFA PHASE I
WHEREAS, the Planning Commission, after duly noticed
public hearing, has recommended that the Council amend the Land
Use Element of the Palo Alto Comprehensive Plan; and
WHEREAS, the City Council has held a duly noticed public
hearing on the matter, and has reviewed the contents of the
Environmental Impact Report ("EIR") prepared for the project and
all other relevant information, including staff reports, and all
testimony, written and oral, presented on the matter;
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. The City Council finds that the public
interest, health, safety and welfare of Palo Alto and the
surrounding region require amendment to the Land Use Map of the
Palo Alto Comprehensive Plan as set forth in Section 2 hereof to
implement Phase I of the South of Forest Avenue Coordinated Area
Plan (the "SOFA CAP11
) in accordance with Land Use Policy L-25 and
Land Use Program L-22, and the related amendment of Land Use
Policy L-8 and Program L-8.
SECTION 2. The City Council hereby amends the Land Use
Map of the Palo Alto Comprehensive Plan by changing the
designation of the area depicted in Exhibit A as Change Area to
"South of Forest Area Coordinated Area Plan." Exhibit A is
attached to this resolution and incorporated into it by this
reference.
SECTION 3. The City Council hereby amends the Land Use
Element of the Palo Alto Comprehensive Plan by revising Policy
L-8 and Program L-8 to read as follows:
"Policy L-8:
Maintain a limit of 3,257,900 square feet of new
non-residential development for the nine planning
areas evaluated in the 1989 Citywide Land Use and
transportation study, and the "Mixed Use" districts

of the South of Forest Area Coordinated Area Plan,
with the understanding that the City Council may
make modifications for specific properties that
allow modest additional growth. Such additional
growth will count toward the 3,257,900 square feet.
Program L-8:
Limit new non-residential development in the
Downtown area and the "Mixed use" districts of the
South of Forest Area Coordinated Area Plan to
350,000 square feet, or 10 percent above the amount
of development existing or approved as of May 1989.
Reevaluate this limit when non-residential
development approvals reach 235,000 square feet."
SECTION 4. The City Council adopts this resolution
in accordance with the California Environmental Quality Act
("CEQA") findings adopted by Resolution No. 7950.
SECTION 5. This resolution shall be effective upon
the thirty-first (31st) day after its adoption; provided that, if
by that date the City Council has not authorized execution, on
behalf of the City, of the Development Agreement between the City
and the Palo Alto Medical Foundation, and the Palo Alto Medical
Foundation has not executed the Development Agreement, then this
resolution shall become void, and shall have no force and effect.
This delayed effective date is intended and shall be construed to
provide a sufficient period of time between adoption of the
resolution and its effective date to allow a complete and exclusive
opportunity for the exercise of the referendum power pursuant to

the Charter of the City of Palo Alto and the constitution of the
State of California. A referendum petition filed after the
effective date shall be rejected as untimely.
