TO: HONORABLE CITY COUNCIL FROM: CITY MANAGER DEPARTMENT: CITY MANAGER'S OFFICE DATE: FEBRUARY 22, 2010 CMR: 149:10 REPORT TYPE: CONSENT SUBJECT: Adoption of a Resolution of the City Council of the City of Palo Alto Confirming the City Manager/Director of Emergency Services' Proclamation of Existence of a Local Emergency RECOMMENDATION The City Manager recommends that the City Council adopt the proposed Resolution Confirming the City Manager/Director of Emergency Services' Proclamation of Existence of a Local Emergency. BACKGROUND On February 17, 2010 the City of Palo Alto experienced a citywide power outage that was caused when a small airplane crashed into the main power transmission lines feeding the City of Palo Alto utilities. As a result of the power outage, the City Manager, acting as Director of Emergency Services, issued a Proclamation of the Existence of a Local Emergency (Attachment B). Although the Local Emergency was terminated on February 18,2010 (Attachment C), Palo Alto Municipal Code section 2.12.50 requires that the City Council ratify any decision of the City Manager to declare a local emergency. Deputy City Manager CITY MANAGER APPROVAL: CMR: 149:10 Page 2 of2 Attachment A Resolution No. ---Resolution of the City Council of the City of Palo Alto Confirming the City ManageriDirector of Emergency Services' Proclamation of Existence of a Local Emergency WHEREAS, section 2.12.50 of the Palo Alto Municipal Code empowers the Director of Emergency Services to proclaim a local emergency if the City Council is not in session and requires that the City Council shall take action to ratify the proclamation within seven days thereafter; and WHEREAS, conditions of extreme peril to the safety of persons and property have arisen within the City of Palo Alto, as a result of condition of extreme peril to the safety of persons and property within the City of Palo Alto caused by a long duration citywide power outage commencing on the 17th day of February, 2010, at which time the City Council of the City of Palo Alto was not in session; and WHEREAS, the City Council does hereby find that the above described conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency in the vicinity of the City of Palo Alto; and WHEREAS, the City Manager acting as the Director of Emergency Services did proclaim the existence of a local emergency within the City of Palo Alto on the 17th day of February, 2010. WHEREAS, the City Manager acting as the Director of Emergency Services terminated the local emergency on the 18th day of February, 2010. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Palo Alto that the Proclamation of Existence of a Local Emergency, as issued by the Director of Emergency Services, is hereby ratified and confirmed. PROCLAMATION OF THE EXISTENCE OF A LOCAL EMERGENCY WHEREAS, section 2.12.50 of the Palo Alto Municipal Code empowers the Director of Emergency Services to request that the City Council of Palo Alto proclaim the existence or threatened existence of a local emergency when the City is affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, the Director of Emergency Services of the City of Palo Alto, does hereby find that: 1.
