HomeMy WebLinkAboutRESO 6731ORIGINAL RESOLUTION NO. 6 7 31 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AUTHORIZING THE CITY MANAGER TO IMPLEMENT UTILITY RATE SCHEDULE W-6 WHEN VOLUNTARY CON- SERVATION MEASURES OR THE CITY'S SUPPLEMENTAL WATER SUPPL~ ARE INADEQUATE TO AVOID ~DVERSE CONSEQUENCES WHEREAS, the City Council has conducted a public hearing and declared in Ordinance No. 3824 that a water shortage emergency exists; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Manager is hereby authorized to imple- ment Utility Rate Schedule W-6 without any additional authority from the City Council when he determines that voluntary water con- servation measures or the City's supplemental water supply are inadequate to avoid the following adverse consequences from the City's water supplier: 1. Monetary penal~ies. 2. Curtailment of the City's water supply. S~CTION 2. The City Manager shall report to the City Council at its next regularly scheduled meeting that he has implemented Utility Rate Schedule W-6. If the City Council takes no action at that time, Utility Rate Schedule W-6 shall continue in reffect until repealed by the City Council. SECTION 3. If the Manager has not exercised the authority granted to h1m by Section 1 of the resolution on or before Septem- ber 11, 1988, such authority shall terminate on September 11, 1988. SECTION 4. The Council finds that enactment of this resolu- tion is exempt from provisions of the California Environmental Quality Act of 1970 because it is immedicai.t= action necessary to prevent or mitigate an emergency, as described in Section 15269(c) of the Guidelines promulgated under said Act.
