HomeMy WebLinkAboutRESO 6710' . . --ESOLUTION NO. 6710 e ORIGINAL RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING AND ADOPTING RULES AND REGULATIONS GOVERNING UTILITY SERVICES AND FEES AND AMENDING SCHEDULES W-5, G-5, E-5, AND S-5 OF THE CITY OF PALO ALTO UTLIT!ES RATES AND CHARGES PERTAINING TO WATER, GAS, ELECTRIC, and WASTEWATER UTILITY CONNfCTION CHARGES WHEREAS, pursuant to Chapter 12.20 of the Palo Alto Municipal Code, the City Council may, by resolution, adopt rules and regula- tions governing utility services other than com.~unication services in the City and fees and charges therefore; and WHEREAS, City Council has determined to revise its present rules and regulations and to adopt new rules and regulations; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1: Pursuant to Section 12.20.010 of the Palo Alto Municipal Code, Schedules W-5 (Water Service), G-5 (Gas Service), E-5 (Electric Service), and s-5 (Wastewaster Service) of the Palo Alto Utilities Rates and Charges are hereby amended to read as shown or. •sheets W-5-1 through W-5-4, G-5-1 through G-5-4, E-5-1 through E-5-6, and S-5-1 through s-s-4• attached hereto and incorporated herein. SECTION 2: The rules and regulations governing utility ser- vices other than communication services in the City and the fees and charges therefore which were distributed to the City Council by CMR as of May 26, 1988, are hereby approved and adopted. SECTION 3: The foregoing changes to said Rules and Regula- tions and connection charges shall become effective July 11, 1988. SECTION 4: The Council finds that none of the provisions of this resolution will have a significant environmental impact. Collection System Charges (Continued): (C) Where a street service has been installed in accordance with the "Improvement Procedure Code," collection system charges must be paid before service can begin. (D) Where service is from a main that is in an easement or right-of-way, the frontage charge shall be that portion of the parcel that borders the right-of-way or easement. {E) If a street, right-of-way, or easement is designed to serve only on one side, the frontage charge shall be double for that portion. {F) If a street, right-of-way, or easement is designed tc serve both sides, but only one side is :~ing developed, special arrangements must be made to provide for the frontage charge of the other side. (G) Where extensions are required to service areas that are not contiguous to existing systems, special arrangements must be made to provide for the cost of the intervening collection system. 3. Service Charges: (A) Additional service connections are available with payment of additional service connection charge as shown in Section C. (B} Replacement of service connections made necessary because of ordinary wear and deterioration will be made without charge. Replacement due to inadequacy will be charged as an additional connection. 4. Installation Under Unusual Conditions: (A) Any condition which. in the opinion of the Chief Engineer of the wastewater utility, will result in a cost higher by more than fifteen (15) percent of the charges set forth in (8) or (C) above will be classified as unusual. The charge for an unusual installation will be based on the Chief Engineer 1 s estimate of the total costs of all materials, labor, and other costs incidental to the installation. Installation Under Unusual Conditions (Continued). (B} In the event wastewater service to a premises is requested and insufficient capacity exists to provide such service, the applicant shall bear the total cost for enlarging the collection system to accomodate serving the applicant. The Chief Engineer may require the applicant to make arrangements for the design and construction of said expansion in accordance with City standards and specifications. Alternatively, the Chief Engineer may elect fer City forces or contractors to design and install respectively such facilities at the applicants expense. Full credit to the applicant will be provided for any oversizing or extra facilities installed to meet service demands above the specific capacity needs of the applicant. 5. Pumping Plants: Where pumping facilities are needed to drain an area into the trunk or collection system, the cost of such facilities will be at the expense of tile developer. 6. Exceptions: (A) Wastewater Service Areas 3 & 4, connections served directly from trunk wastewater: The collection system charges (Section B) will be based on maximum frontage of 660 feet. This exception applies to single applications for service and does not apply to subdivisions or tracts. (8) The developer may, at his option, furnish and install the on-site wastewater system at nis expense and in accord~nce with City's specifications in lieu of street frontage and connection charges. TERRITORY: Wit dn the incorporated limits of the City and land owned or leased by the Cit I· PREPA'fli'~NT OF CHARGES: All fees must be paid prior to the scheduling of any construction. GENERAL DESCRIPTION OF CHARGES: A. Underground Systems: The connection charges for underground residential, coT!lllercial, or industrial service will consist of one or more of the following types of fees, where applicable. l. Service Connection Fee: Where the City installs any portion of service conductors, a service connection fee shall be charged. 2. On-site Distribution System Fee: Where the City instal 1 s or will install the conductors (primary and secondary) and switches in duct systems provided by the developer within the boundaries of a subdivision or other development, an on-site distr;bution system fee shall be charged. 3. Off-site Distribution System Fee: Where the City installs or will install an electric distribution system, a system extension, or a system reinforcement outside the boundaries of a subdivision or other development to be served, an off-site distribution system fee shall be charged. B. Overhead Services: No overhead service for new construction shall be permitted except with the approval of · ·;e Chief Electrical Engineer and only after a finding that an underground service is not feasible. Where such service is al lowed, an overhead service foe shall be charged. Temporary Service: ELECTRIC SERVICE COllECTION UTILITY RATE SCHEDULE E-5 (CONTINUED) A fee shall be charged to connect a temporary service. For an underground service. the customer shall furnish and install all material up to the designated point of ccnnection except the meter. ~or an overhead service, the City will supply only the meter and the service-drop conductors from existing facilities. All additional facilities, when required, shai1 be supplied and removed at the customer's expense. O. Replacement Service: Where, in the opinion of tne Chief Electrical Engineer. replacement of service conductors is necessary, such replacement will be made without charge except under the following circumstances: 1. Customer wishes to increase the capacity of a primary voltage service. 2. Customer wishes to change the existing underground service to a different secondary voltage set·vice but the existing conduit is inadequate. 3. Customer wishes to cha.nge the existing service to a size larger than a 200-ampere, 3-wire secondary voltage service. 4. Customer or his agents have damaged the service. 5. The original installation was not installed in accordance with City standards and the City has not accepted responsibility for maintenance. 6. Service conduits have been damaged or obstructed. When the City replaces a service without charge to the customer. the customer is obligated to accept a shutdown of service during regular working hours to achieve the replacement. The time of the shutdown shall be agreed upon as mutually acceptable. When the City replaces a service for the convenience of the customer during other than regular working hours, it shall be done at t~e customer's ex~nse. The customer shall pay the entire cost of the overtime labor. not the incremental cost. Underground Systems: 1. Residential; These charges apply to development in which electric metering will be on a sin~le-family basis. By Estimate (C) Off-Site Distribution System Fee; (1) Where an underground distribution system extension to service a new development remote from existing distribution systems is determined by the Chief Electrical Engineer to not be feasible, the following conditions and charges shall apply in addition to the off-site d1stribution system fee under paragraph A.3.a above. (b} The grant of easements shall terminate automatically and the overhead faciiities shall be removed by the City when the underground electric distribution system is completed. {c) The estimated charge for the installation and removal of the temporary overhead distribution system extension shal i be ;:>aid by the applicant. (C) Where a property has no street frontage, other than that required for a driveway, and is served from an easeme~t. the frontage charge shall be based upon that portion of the parcel that borders the easement. (0) If the street or easement is designed to serve only on one side, the free footage shall be reduced from 70 feet to 35 feet. Approved detector check valves with bypass assemblies must be provided by owner on all fire services. An exception may be made where only an automatic fire sprinkler system is served. provided the sprinkler control equipment is within ten feet of the end of the street portion of the fire service. Charges for service connections of 1-inch through 2-inch will be reduced $50 if connection is installed at time main is constructed. A reduction of $150 applies for service connections larger than 2-inch if connection is installed at time main is constructed. D. Additional Meters on Connection: With new connection .. Distribution System Charges (Continued) (E) If a street. right-of-way, or easement is designed to serve only on one side. the frontage charge shall be doubled. (F} If a street, right-of-way, or easement is designed to serve both sides, but only one side is being developed, special arrangements must be made to provide for the frontage charge of the other side. (G} Where extensions are required to service areas that are not contiguous to existing system, special arrangements must be made to provide for the cost of the intervening distribution system. 3. Service Charges: (A) Additional $ervice connections are available with payment of additional service connection charge as shown in Section C. (8) Replacement of service connections made necessary because of ordinary wear and deterioration will be made without charge. Replacement due to inadequacy will be charged as an additional service connection. 4. Installation Under Unusual Conditions: (A) Any condition which, in the opinion of the Chief Engineer of the tilter utility will result in a cost higher by more than fifteen (15) percent of the charges set forth in (8), {C), or (0) above will be classified as unusual. The charge for an unusual installation will be based on the Chief Engineer's estimate of the total costs of all materials. labor and other costs incidental to the installation. (B) In the event water service to a premises is requested and insufficient capacity exists to provide such service, the applicant shall bear the total cost for enlarging the distribution system to accomodate serving the applicant. The Chief Engineer may require the applicant to make arrangements for the design and constructio~ of said expansion in accordance with City standards and specifications. Alternatively, the Chief Engineer may elect for City forces or contractors to design and install respectively such facilities at the applicants expense. Full credit to the applicant will be provided for any oversizing of extra facilities installed to meet service demands above the specific capacity needs of the applicant.
