RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ~<'
APPROVING THE DESTRUCTION OF CERTAIN POLICE DEPARTMENT
RECORDS, DOCUMENTS, AND PAPERS, PURSUANT TO SECTIONS
34090 AND 34090.6 OF THE GOVERNMENT CODE OF
THE STATE OF CALIFORNIA
WHEREAS the Chief of the Palo Alto Police Department has sub-
mitted a request for authority to destroy obsolete records; and
WHEREAS in accordance W'ith the procedures and requirements of
sections 34090 and 3409C.6 of the California Government Code said
records may be destroyed with the approval of the City Council and
the written consent of tt..? City Attorney; and
WHEREAS the City Attorney has consented in writing to the
request to destroy these records1
NOW, THEREFORE, be it RESOLVED by the Council of the City of
Palo Alto:

(a) Recordings of telephone and radio communications over
one hundred ( 100) days old, providing such r~cordings
are not evidence in any claim filed or in any pending
litigation (or potential claims ancl litigation), in
which case, such recordings shall be preserved for one
hundred ( 100) days after the conclusion of the
litigation.
(b) Accident reports, excluding those relating to fatal
accidents, over three (3) years old, provided that the
cases are not presently involved in litigation.
(c) Accident reports relating to fatal accidents over five
(5) years old, provided that the cases are not presently
involved in litigation.
(d) All alpha name index cards, which do not contain crimi-
nal entries, over three (3) years old.
( e) Reports rt?lating to found or recovered bicycles over
three (3} yebrs old.
(f) All crime and eupplemental reports of infractions, mis-
demeanors, and felonies over (5) years old, providing:
(1) they have been purged by the Department of Justice
of the State of California;

(2) they do not relate to unserved warrants1
( 3 / they do not involve identifiable items which have
not been recovered;
( 4) they do not relate to 290 Penal Code, 457 .1 Penal
Code or 11590 Health and Safety Code registrants1
(5) they do not relate to a c~iminal death case7
( 6) they do not relate to violations 1 isted in Penal
Code Sections 799 and 800; and
( 7) t~ e cases are not presently involved in either
civil or criminal litigation.
(g) Incident reports over five (5) years old.
(h) All arrest records which have been purged by the Depart-
ment of Justice.
(i) Parking citations over five (5) years old.
(j) Moving citations over five (5) years old.
(k) File cards relating to warrants, which have been served
and recalled, 0ver two (2) years old.
(1) Calls-for-service cards over three (3) years old, pro-
viding such cards are not evidence in any claim filed or
pending litigation (or potential claims and litigation),
in which case such cards shall be preserved for three
(3) years after the conclusion of litigation.
(m) Calls-for-service print-outs over three (3) years old.
(n) Telephone records over three {3) years old.
(o) Restraining orders over two (2) years old or ninety (90)
days old from the date of expiration, whichever is later
in time.
(p) Police daily bulletins over two (2) years old.
( q) Field interview cards over two ( 2) years old.
(r) All records relating to animal inventory over two ( 2)
years old.
( s} Hum&.ne officers daily activity records and logs over two
( 2) years old.
( t) Dog license records over three ( 3 ) years old from the
date of expiration.

(u) Nuisance complaints received by Animal Services over
three (3) years old.
(v) Reports of animal bites over thr~e (3) years old.
(w) Municipa~ Code violations and warnings issued by Animal
Services over three (3) years old.
(x) Records relating to rabies vaccinations older than three
(3) years old from the date of expiration.
( y) Any documents relating to complaints or investigations
in response to citizen complaints relating to members of
the Police Department and internal affairs investigation
files shall be retained for a period of at least five
(5) years, providing such documents are not evidence in
any claim filed or any pending litigation (or potential
litigation), in which case such documents shall be
preserved for five ( 5) years after the conclusion of
litigation.
