RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO REQUEST AN EXEMPTION
FROM THE CONVENIENCE ZONE REQUIREMENTS OF THE CALIFORNIA BEVERAGE
CONTAINER RECYCLING AND LITTER REDUCTION ACT BECAUSE THE CITY HAS
AN ESTABLISHEO CURBSIDE RECYCLING PROGRAM WI TH WEEKLY COLLECT ION
SERVICE
WHEREAS, the City of the Palo Alto has provided public notice
of the City's intent to request an exemption from the convenience
zone requirements of the California Beverage Containet" Recycling
and Litter Reduction Act for the Palo Alto Curbside Recycling
program with weekly collection service1
WHEREAS, on Jul.r 13, 1987 a public hearing was held and
testimony was received regarding public support or opposition to
the proposed action• and
WHEREAS, the City of Palo Alto has evaluated and identified
alternative recycling locations available to the consumer to
conveniently return beverage containers for the redemption value
and redemption bonus; and
WHEREAS, the City of Palo Alto has reviewed the exemption
criteria, completed the exemption request form and listened to and
responded to all public testimony regarding the exemption
proposal1 and
WHEREAS, the City of Palo Alto has determined that, if
granted, the proposed exemption to convenience zones 2378, 2330,
2381, 2383, 2384, 2385, 2386, and 2~87, will not significantly
decrease the ability of consumers to return beverage <:ontainers
for the redemption value and any applicable redemption bonus; and
WHEREAS, the City of Palo Alto has responded to all of the
requirements of the state regulations governing exemption of
convenience zonesi and
NOW, THEREFORE, be it RESOLVED that the City of Palo Alto
authorizes the Director of Public Works to submit the exe111ption
request to the Chief of the ,~·iv is ion of Recycling, State of
California.
