Easement Vacation .,.~( RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ORDERING THE SUfftARY VACATION OF A PUBLIC SERVICE EASEMENT FOR OVERHEAD UTILITIES AT 650/644 MAYBELL AVENUE ~HEREAS. the public: service easement for overhead utfl f ties has been relocated as a result of construe"'.tion on the property; and WHEREAS, as a result of safd relocation of utility facilities. no other facilities are located within the old easement; and WHEREAS, from all evid@nce subll1tted to the Council of the City of Palo Alto it is found that said pub 1i c service easewen t as de serf bed herein 1 s not necessary for present or prospective public use. WHEREAS. it is the int.ent of the Cou11ci1 of the City of Palo Alto to vacate the public service easement for utilities recorded fn Book 570 of ~~ps at Page 38, in the City of Pdlo Alto. County of Santa Clar-a, State of California; and WHEREAS. the Council of the City of Palo Al to 1ntends to vacate such public service easement according to the procedures set forth in the Califor-nia Streets and Highways Code division 9, Pa~t 3, Chapter 4 (Section 58330 et seq.). NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as fo: lows: SECTIOH 1. This vacation fs made under the authority of California Streets and Highways Code Chapter 4 of Part 3 of Division 9 of Califor-nia Cc.de cmmenc1ng at §8330 et seq. The publfc service easement to be vacated 1s more part1cularly described 1n Exh161t "'A"' and shoim 1n Exhibit •a•, which Exhibits are attached hereto and incorporated herein. SECTION 3. The Council finds that this project f!t categorically exempt from the requirements of the talffornfa Environmental Quality Control Act a~1d no environmental impact assessment is necessary. SECTION 4. The City Clerk, acting through tile Manager, Real Property, shall cause a certified copy of this resolution, attested by the Cf ty Clerk under seal, to be recorded fn the office of the County Recorder of Santa Clara.
