ORIGINAL RESOLUTION NO. 6606 ----- RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING RESOLUTION NO. 6601 CLARIFYING PROVISIONS OF A LICENSE GRANTED TO CENTURY FEDERAL, INCORPOkATED WHEREAS, on April 6, 1987, the Council of the City of Palo Alto adopted Resolution No. 6601, granting a lic~nse to Century Federal, Inc. to construct and operate a CATV system (hereafter "LICENSE"); and WHEREAS, in adapting terms and conditions from those suitable to a franchise agreement to said LICENSE, staff inadvertently cre- ated confusion in the terms and conditions of the LICENSE per- taininq to the institutional cable; and WHEREAS, the followinq changes, deletions and addition to the pertinent secti~ns of the LICENSE would clarify the City's intent in requiring institutional cable: NOW, THEREFORE, the council of the City of Palo Alto does hereby RESOLVE as follcws: SECTION 1-Section 1.26 Of the LICENSE is hereby amended to de- lete the reference to •Appendix p• and to insert in its place the phrase "Appendix A", to read as follows: 11 lw26 'Institutional cable' means t:he cable(&) or bandwidth on a cable provided pursuant to Section 4.5 hereof and Appendix A to this License, a portion ot which the Cmapany ahall make available, without charqe, to the City and to other qovernaental and educational institutions." SEcrroN 2. Lina one an~ the last line of Section 4 .. 5.0l of the LICENSE are hereby amended to del~~e the references to Appendix F, and to insert references to Appe~ix A where appropriate, to read as foll""8: "4.5.01 As provided in Appendix A to this License, the Coapany shall: ••• as provided in Appendix A to this License.• SECTION 3. SECTION 4. Appendix P of the LICENSE is hereby deleted. & SECTION 5. Appendix A, Section I is hereby c.unended to add a sub- section "D" to read as follows: D. Access to Upstream Capacity for Lear•d, Government and.Access Channel Users: One upstreaia channel on the A cable will be reserved for use by Leased, Government and Access Channel user~. on the B cable, an addi · .ional three upstream channels will be reaerved. for use ~Y the City, and an additional or.a upstream channel for the CAO." SEC!'ION 6. All other teras and conditions of the LICENSE shall remain In full force and effect.
