HomeMy WebLinkAboutRESO 6601• • RESOLUTION NO. 6601 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO, ACTING UNDER A PRELIMINARY INJUNCTION IN a.s. DISTRICT COURT CASE NUMBER C-85-2168, GRANTING A LICENSE TO CENTURY FEDERAL, INC. TO CONSTRUCT AND OPERATE A CABLE SYSTEM WHEREAS, the City of Palo Alto is a party defendant in a law suit entitled Century Federal, Inc., v. City of Palo, et al., Case No. C-85-2168 EFL, now pending in the United States Federal District Court for the Northern District of California; and WHEREAS, the City is required by a preliminary injunction of said court, the original of which was filed on March 23, 1987, to issue a license to plaintiff in said case, Century Federal, Inc., so as to allow it to •construct and operate a cabl9 television system within the entire Service Area• covered by the fr~nchise agreement between defendant ~ity of Palo Alto and other defendants and Cable Communications Cooperative of Palo Alto, Inc.1 NOW, THE~£FORE, the Council of the City of Palo Alto does hereby RESOLVE as follows: Section 1: A license is hereby issued on terms and conditions which are identical in ea~h and every material respect to that certain Otdinance of the City of Palo Alto numbered 3744, each of which terms and conditions is hereby referred to and incorporated herein ~Y this reference. a copy of said ordinance is on file in the office of the City Clerk. Each internal reference in Ordinance No. 3744 shall be deemed to ref er to this license. Section ·2: This license shall be subject to further oraer of ffie court or other proceedings as provided in said preliminary injunction. Section 3: The terms and conditions of this license ~hall survive any repeal or referendum of Ordinance No. 3744.
