HomeMy WebLinkAboutRESO 6581p • • RESOLUTION NO. 6581 RESOLUTIOh OF THE COUNCIL OF THE CITr OF PALO ALTO AUTHORU;:JNG THE FILING OF A CLAIM WITH Ttrn METRO- FOLI'l'AN TRANSPORTATION COMMISSION FOR ALLOCATION OF TRANSPORTAEION DEVELOPMENT ACT FUNDS FOR FISCAL YEh.R 1987-88 WbEREAS, the Transportation Development Act (•TnA•), as amended (Public Utilities Code section 99200 et seq.), provides for the disbursement of funds from the !.ocal Transportation Fund of the Ccunty of Santa Clara for use by eligible claiman~s fo~ the purpose of providing ped~strian ~nd bicycle f3cilities1 and WHEREAS, pursuant to the provisions of the TOA, as amended, and pursuant to the applicable rule$ and regulations thereunder \21 Cal. Admin. Code se~tion 6600 ct seq.), a prospective claimant wishing to receive an allocation fro• the Local Transportation Fund shall fil• its claim with the Metropolitan T~~nsportation Com•ission7 and WHEREAS; the City of Palo Alto i& an eligible claimant for TOA funds, pursuant to Public Utilities Code section 99234 as expressed in the City of Palo Alto's opinion of counsel, dated December 18, 1986: and WHEREAS, TD~ funds from the Local Transpo~tatio~ Fund of Santa Clara County will be required in fiscal year 1987-88 for the purpose of improving pedestrian &nd bic~cle facilities in Pa~o Alto: and WHEREAS, this claim is i.. accordance with the policy in th.e Palo Alto Comprehensive Plan to promote bicycle use. NOW, TBERBJi'ORB, the Council of the City of Palo Alto does RESOLVE as follows: Section l. The Council hereby approves and authorizes the City Manager to e~ecute and file an appropriate claia, together with all necessary supporting documents, with the Metropolitan Transportation Com•ission for an allocation of One Hundred Porty-Five Thousand Five Hundred Dollars ($145,500) in TDA funds in fiscal y~ar 1987-88 for the purpose of providing the following pedestrian and bicycle projects in Palo Alto: (ll Bicycle Traffic School program ($1,500)1 (2) Bicycle Sensitive Traffic Loop in~t&llations ($3,000)1 (3) Middlefield Road sidewalk at San Francisquito Creek ($10,~00); (4) Adobe creek Bikeway at u.s. 101 ($28,000); (5) Bryant/Embarcadero Traffic Signal ($75,000)J an~ (6) ~mbarcadero/El Camino Island Reccnstruction ($28,000). section·2. The City Clerk is hereby directed to trensait a copy of this resolution to the Metropolitan Transportation Commiseion in conjunction with the filing of the claim, ~nd the Metropolitan T-:-ansportation Cooaioaion is raquested to concur in these findings ar1d grant the allocations of ~unds as specified herein. .. . . . ,; • • Sec~ion 3. The City of Palo Allo is authoLi~ed to provide and assi&; public transportation by acquisiti~~, construction and operation of existing or additional tra1 .t facilit~es, including facilities provided !:·Jr exclusive use by pedestrians and bicycles. This assistance may be provided directly or by contractual a~rangements with other parties. 2. T~e City of Palo Alto is an eligible claimant for TOA funds pursuant to Pablic Utilities C~de section 99234. 3. I have r&viewed the pertinent State and local laws, and I am of the opini~n that there is no \egal i•pediment to the City of Palo Alto aaking application for TDA fundd.
