A RESOLUTION OF THE COUNCIL OF TH~ CITY OF PALO ALTO ASSUMING
RESPONS!BILTY 31 THE CITY FOR IMPLeMENTING CHAPTER 6.95 OF
DIVISION lO OF THE STATE OF CALIFORNIA HEAL~H AND SAFETY CODE
~S TH~ LOCAL ADMINISTERING AGENCY
~HEREAS, the Council of the City of Palo Alto adorted Title 17
of the Palo Alto Municipal Code in July 1983, regulating the storage
and hondli11g of hazard::>us materials and providing business inventory
reporting requirements1 and
WHEREAS, the State of California tas added Chapter 6.95 to
Division 20 of the Health and Safety Code providing regulations
regarding business plans, area res?onse plans, and hazardous
materials incident reporting1 and,
WHEREAS, it is intended that all haz~rdous mdte· .i.als inventorie(j
and business ~lans provide information essential to local public
safety ~tficials in order to m~et their responsibility for protecting
the health and welfare of the community; and
WHEREAS, the Palo Alto Fire Department is currently enforcing
the requirements of ~aid Title 17, and the additional requirements of
the r.ew state legislation ~ra a logical extension of this eff.ort1
and
~BEREAS, the Palo Alto Fire Department is responsible for
city-wide disaster planning, including response to hazardous
materials emergencies1
NOW, THEREFORE, SE IT .RESOLVED that thEt Council ct: the \..ity of
Palo Alto does hereby a~sume responsibility for impleme~ting Chapter
6.95 of Division 20 of the Califcr~ia Health and Safety Code as the
administering agency within the City.
