RESOLUTION OF THE COUNCIL OF THE·~~C-I-T-~-OF PALO ALTO
DECLARING ITS INT!!:NTION TO AMEND SECTION 12.16 .. 020 OF
CHAPTER 12.16 OF TITLE 12 OF THE PALO ALTO MUNICIPAL CODE
B'! ESTABLISHING UNDERGROUND UTILITY DISTRICT NUMBER 30
The Council of the City of Palo Alto does RESOLVE as follows:
SECTION l. That in its opinion the public necessity, health
and safety, require, ~nd that it is the intention of said council,
pursuant to Section 12.16 of Title 12 of the Palo Alto Municipal
Code, to amend Section 12.16.020 of said code, by ordering the es-
tablishment of an Underground Utility District and to prohibit the
construction in and require the removal from said proposed dis-
trict of all poles and overhead lines and associated overhead
structures used or useful in supplying electric, communication or
similar and associated services.
SECXION 2. That the name of the proposed district is Under-
groun<rlltfiity District Number 30 of the City of Palo Alto, com-
monly known as Crescent Park III.
SECTION 3. That the descriptio~.of the area co~prising said
district is as follows&
All of the area in the County of Santa Clara, City
of Palo Alto, bounded by San Francisquito Creek,
Island Drive, Hamilton Avenue, Center Drive, Dana.
Avenue, Alaster Avenue and Jackson Drive, all as
more particularly described on that certain map
entitled •underground Utility District Number Jo,•
on file in the office of the City Clerk.
SECTION 4. That from and afte= the effective date of the es-
tablishment of said proposed district, no person or utility shall
erect or construct within ~aid district any pole, overhead lines
or associated overhead structure used or useful in supplying elec-
tric, communication or similar and associated services.
SECTION s. That within ninety (90) days from the date of th$
completion and acceptance of the proposed underground facilities
within said district to be constructed by the City of Palo Alto
and the Pacific Bell Company, all poles and overhead lines and as-
sociated structures used or useful in supplying electric, communi-
cation or similar and asso-ciated services in said proposed die-
trict shall be removed, and from and after said date no person or
utility shall use or maintain such facilities within said proposed
district. Additional notice shall be given after said completion
date has been precisely determined.

SECTION 6. That NOTICE IS BEREBY GIVEN that Monday, the 9th
day of Rarch, l987, at the hour of 7a30 o'clock p.m., in the reg-
ular ~•eting place of said City Council, Civic Cent~r, Palo Alto,
California, are hereby fixed as the time and place when aod wher~
said council shall hear all protests and receive evidence for and
against the action herein proposed, and when and where aaid coun-
cil shall consider and finally deteraine whether the public neces-
sity, health and safety require the establishment of said district
and the removal of poles, overhead wires, and associated overhead
structures, and the underground installation of wires and facili-
ties for supplying electric:, eoaaaunication and similar or asso-
ciated services in the district hereinabove described.
SECTION 7. That at said hearing, all persons interested
shall be given an opportunity to be heard. Said hearing ~ay be
continued from tiae to ti•e as deterNined by said council.
SECTION 8. That Larry Starr, Chief Electrical Engineer,
Depart•ent of Utilities, City of Palo Alto, is hereby designated
as the person to answer inquiries regarding the protest proceed-
ings, to be had herein and aay be contacted during regular off ice
hours at Palo Alto Civic center, 250 Hamilton Avenue, Palo Alto,
California, 94301, or by calling (415) 329-2619.
SBCTION 9. That the Clerk of th• City shall give notice of
eaid hearing by mailing copies of this resolution to all property
owners within said proposed district as shown on the last equal-
ized tax roll of the City~ and to all utilities supplying elec-
tric, comaunication or si•ilar or associated services within said
proposed district, aaid mailing to be completed at least thirty
(30) days prior to the da~e of said hearing.
