Resolution of the Councn of the Cit,y of Palo Alto
1n Support of ~nta Clara Valley Water Dfstr1ct Supervi ':.fng
Cleanup of Underground Fuel Tank Leaks
WHEREAS, this Council recognizes the existence of a serious threat to the
groundwater resources of the Cot:nty and of th ts Cfty and fts f nhabf tants by
reason of fuel leaks frOlll storage tanks into the tatderly1ng sons and in thfs
manner threatening to contalllinate and degrade the acquf fers "1fch provf de
dc:mesti c .a.ter; and
WHEREAS, thf s Council 1s advt sed and ff nds that over ihree hundred l eakf ng
fuel sites are suspected to exist in Santa Clara County and that the nullber fs
expected to rf se to seven h'!Aftdred upon closer investfgatf on; and this Council
f s further advised that the San Francisco Regional Water Quality Control Board
has been unable to secure an allocation of 1111npowr to supervise fts cleanup
orders and sees no prospect of such an allocation; and
WHEREAS. this etuncil find~ that the Santa C1ara Valley Water Of strict is
the local p;Ablfc agency best equipped by reason of county-wide jur1sd1ctfon,
experience and f\ydrogeologic expert1 se to supervf se cleanup of such spills as
they are cff scovered;
WW, TifEREFORE. the Council of the Cfty of PalG Alto does resolve as
follows:
FIRST: That thf s Council hereby requests 5anta Clara Yal ley Water
Of strfct to accept the task of overseeing cleanup of fuel leaks wf thfn and
wf thout the Cf V;
SECOND: That the Counc:fl f~l ly understands that the saf d Di strict lacks
legal authOrity to fssue cleanup orders to dtschargers and that therefora the
.a>rk wfll have to be done and should properly be done in cooperatfon wfth the
cognizant Regional Water Qualf1\Y Control Board; and
THIRD: That the Counctl further recognizes that the task 1 s beyond the
present ff seal resources of the Of strf ct and that f11uff ng must be sought and
appliedj f n -'tfch endeavor the Cfty su~rts, encourages. and will assfst the
Df strfc::t.
