OF PALO ALTO AMENDING SCHEDULE E-2 OF THE CITY OF PALO ALTO UT!L:TIES RATES AND CHARGES PERTAINING TO COMMERCIAL RATES AND LOAD MANAGEM~N1' PROGRAMS The Council of the City of Palo Alto does RESOLVE as follows: SECTION l. Pursuant to Sectior. 12.20.010 of the Palo Alto Muni- cipal Code, Schedule E-2 (Commercial Electric Service) of the Palo Alto Utilities Rates and Charges hereby is amended to read as sh,,wn on Sheets E-2-1, E-2-2, E-2-3, E-2-4, attached hereto and incorporated herein. SECTION 2. This Council finds that the revenue derived from the authorized adjustments of said electric rates by the City Manager shall be used only for the purposes set forth in the Palo Alto City Charter, Article VII, Section 2, entitled •Public Utilities Revenue•. The adop- tion of this Resolution ia, the::efore, specifically exempted under Public Resources Code Section 21080{b) (8) from the requirements of CEQA. SECTION 3. CIRIEJtCIAL &mIC SElYICE UTILITY RATE SCHEDULE E-2 {CONTINUED} Upon approval by the City. a 10 percent discount wf11 be applied to a customer's electric bill if such customer has installed a solar energy system and •t the following criteria: (1) The solar energy syste111 is in confor111nce with the City's perfor1111nce and aesthetic standards; (2} The solar energy system is designed to provide for 50 percent or 1110re of the residential d01Rest1c water heating or space heating require111ents; and (3) Appropriate City pennits are acquired. Pc.r Factor: At the City's option, VAR-hour Metering, used for power factor calcu- latfon, will be installed on the service of any new customer whose de111nd is expected to exceed 300 ki 1 owatts and upon the service of any existing customer whose de111and has exceeded 300 kiloNatts for three consecutive months. The City may exercise the option of removing the YAR~hour metering frOlft the service of a custaner whose deaend has been below 200 kilowatts for four consecutive IQnths. This ~orrect;ve program shall continue fn effect at the init1a1 power-factor average up to a rM.XfA'H.lll of five {S) years, until the customer 1 s power-factor reaches 90 percent for sh (6 j cons-.cutive 110nths. If the customer tails to achieve a 90 percent power factor for six (6) consecutive months during such five (5)-year period, the power factor penalty shall then become effective on the customer billing. During the time this agreement is in effect, the City shall not impose any other power-factor penalty on the customer. If the above agreement is not implemented, VAR-hour metering shall be installed and the customer shall be billed in accordance with the above provisions, including the power-factor pen!lty. Cofttract Load Manase-nt PrcMJr• This optional program is available to all three-phase electric service custoiners with average 111aximtl'll demand greater than 500 kW and who can provide at l~ast 100 kW of load reduction. All conditions relating to the terms of this program including additional details shall be covered by a service contract. The City may request that the customer under certain conditions curtail load or reduce load to the dema.nd limit set under the contract's terms. The customer shall receive a credit of $3.00 per kW load reduction :;>eriod for reduc~d load. A penalty of $3.00 per kW per load reduction shall be applied consistent with the service contract when the customer fails to meet the cont~act terms. Emergency load reductions 1ay be requested frOlll all customers when required and are not considered load reduction periods ur1der the Contract Load Management Program. All customers served under this pr09ram shall have a time-of-day 11eterin9 systelli installed by the City and an assigned nunt>er direct-dial telephone line uy be required to be provided by the custo111er. If the City requires the customer to provide 1 phone line. a compensatory credit will be applied to the bill.
