A RESOLUTION PRELIMINARILY APPROVING ENGINEER'S
REPORT, APPOINTING TIME ANO PLACE OF HEARING
PROTESTS ANO DIRECTING NOTICE THEREOF, AND
DESCRIBING PROPOSED BOUNDARIES OF ASSESSMENT
OISIRICT ANO DIRECTING FILING OF BOUNDARY MAP
CALIFORNIA AVENUE PARKING ASSESSMENT DISTRICT 86-1
RESOLVED, by the C1ty Council of the C1ty of Palo Alto, County of Santa
Clara, Ca11forn1a. that
WHEREAS, on January 20, 1986 th 1s Counc n adopted Re so 1 ut ion
No. 6485, a Resolution of Pre~ im1nary Determination and of Intent1on tQ
Make Acquisitions and Improvements, in which said acquisitions and
improvements were referred to the Engineer of Work for the purpose of making
and filing a report 1n writing under and pursuant to the Municipal
Improvement Act of 1913; and
WHEREAS, sa.1d report has been made and filed and duly considered by
th1 s Counci 1 ;
NOW, THEREFORE, IT IS FOUND. DETERMINED and ORDERED, as follows:
1. Said report as a whole and each part thereof, to w1t:
(a) the plans and specifications for the proposed 1mprovements9
(b) the maps and descriptions of the lands and easements to be
acquired, if any;
(c) the engineer1 s estimate of the itemized and total costs and
expenses of said acquisitions and improvements, and of the incidental
expenses in connection therewith;

(d) the diagram showing the assessinent district and the boundaries
and dimensions of the respective subd1v1s1ons of land within said district;
and
( e) the annual assessment of the tota 1 amount of the costs and
expenses of the proposed acquisitions and improvemerits upon the several
subdivisions of land 1n safd district in propo~tion to the estimated
benefits to be received by said subdivisfons, respectively, from said
acquf sit1ons and improvements, and of the expenses incidental thereto in
accordance with the proceedings formula herein spec1f1ed;
are sufficient and are preliminarily approved.
2. Said report shall stand as the Engineer's Report for the purpose of
all subsequent proceedings herein.
3. Monday, the 24th day of February. 1986, at the hour cf 7:30 o1c1ock
p.m., fn the regular lfteet1ng place of this Council, City Hall, 250 Hamilton
Avenue, Palo Alto, California, be, and the same are hereby appointed and
fixed as the time and place when and where this Council wfll consider and
finally determine whether the public fnterest. convenience and necessity
require said acqu1s1t1ons and 111proveA1ents 1 and when and where 1t will
consider and ffnally act upon said Engineer's Report.
4. The City Clerk shall cause notice of said hearing to be given by
publicat1on once a week for tvo weeks in the Pen1nsuia Times Tribune and the
Palo Alto Weekly, n~spapers published and circulated in the City of Palo
Alto, and by conspicuous posting along all the open streets \:tithin said
assessment district at not more than three hundred feet apart, and not less
than three 1n all. The first pub11cat1on of $a1d not1ce shall be rude and
said posting shall be comple~ed at least twenty days before the date herein
set for said hearing. Said notices s~ll be headed "Notfce of Improvement•

(fn letters of not less than one 1nch 1n height on the posted notice) and
shall, 1n leg1ble characters, state and contain. the fact and date of the
passage of sa1d Resoll!tion of Preliminary Determination and of Intention,
the ff ling of said report, the date, hour and place set for and the purpose
of the hearing on said resolution and report and of protests; the total
estimated cost, and a brief description of the proposed acquisitions and
'fiaprovements; that any person interested may f1le a protest in writing as
provided in D1v1 sf on 12 of the Stree4.;s and Highways Code; and reference to
said resolution and report for further particulars.
5. Said Clerk shall also cause notice of said hearing to be mailed,
postage prepaid, at least twenty days before the date herein set for said
hearing, to all persons owning real property to be assessed whose names and
addresses appear on the last equalized assessment roll for general taxes or
are known to said Clerk. Safd notices shall contain, in addition to the
matters provided above for the notice to be pub11shed and posted, the
amount, as shown by said report, to be assessed against the particular
parcel· covered by each such notice, respectively. Said notices shall be
mailed to such owners at their addresses as same appear on said assessment
roll, or as known to said Clerk, or to both if not the same.
6. The proposed boundaries of safd assessment d1 strict are hereby
descYfbed as shown on a map thereof filed 1n the office of sa1d Clerk, which
fndtcates by a boundary line the extent of t;.he territory 1nciuded in the
proposed assesS11ent. d1strfct an1j whfch shall govern for all detafls as to
the extent of such df strfct, reference to such map being hereby r;.)de for
particulars. Said up contains the nue of uid City and a distinctive
designation 1n words or by nl.lllber of the d1strfct shown thereon.

7. Sa1d Clerk shall endorse certificates on the original a~d at least
one copy of said map evidencing the aforesaid fil 1ng and the date and
adoption of this resolution, and with1n 15 days after adoption of this
resolutfon, and 1n no event later than 15 days prior to said hearing, shall
file a copy thereof with the County Recorder of the County of Santi! Clara,
1n which County all of such proposed assessment d1 strict is located. The
County Recorder shall endorse on said copy of said map the time and date of
fi Jing and shall fa~ten the same securely in a book of maps of assessment
districts which he shall keep 1n his officet and indax such map by the name
of said City and by the distinctive designation ~f the district as shown on
such map.
