RESOLUTION NO. 6380
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING PLANS AND SPECIFICATIONS, CALLING FOR
S£ALED PROPOSALS AND FIXING LIQUIDATED DAMAGES FOR
FAILURE TO COMPLETE THE WORK WITHIN THE TIME SPECIFIED
PARK BOULEVARD UNDERGROUND UTILITIES
ASSBSSMENT DISTRICT NO. 28
The Council of the City of Palo Alto does RESOLVE as follows:
SECTION 1. on March 4, 1985, the Council adopted Resolution No.
6357, a Resolution of Intention to Acquire and Construct Improvements
Park Boulevard Underground Utilities Conversion, and plans and
specifications suitable for calling for bids for construction of said
improvements have been submitted for approval by the Council.
SECTION·2. Said plans and specifications for the construction of
said improvements, on file in the office of the City Clerk, a·e hereby
approved.
SECTION 3. The City Clerk is hereby directed to publish once a
week for two weeks in a newspaper of general cir~ulation published and
circulated in the City of Palo Alto, a notice inviting sealed proposals
or bids for the construction of said improvements, and referring to the
plans and specifications on file in the off ice of the City Clerk, the
first publication of which notice shall be at least fourteen (14) days
prior to the time fixed for opening bids.
S!CTtON_.:.!. All proposals or bids shall be accompanied by cash, a
cashier's or certified check payable to the order of the City of Palo
Alto amounting to ten percent (10•) of the bid, or by a ~ond in said
amount and payable to the City of Palo Alto signed by the bidder and a
corporate surety or by the bidder. and two sureties who shall justify
before any officer CQllPetent to administer an oath, in double said
amount and over and above all statutory exemptions. The amount so
posted shall be forfeited to the City in case the bidder depositing the
same does not, within fifteen (15) days after written notice that the
contract has been awarded to him, enter into the cont~act to construct
said improvements.
SECTION 5. That in the event the contractor, contracting owners
included, does not complete the work within the time limit specified in
the proposed contract or within such further time as the Council shall
have authorized, the concractor or contracting owners, as the case may
be, shall pay to the City liquidated dam.ages in the amount of One Hun-
dred Dollars ($100) per calendar day for each and every day's delay in
finishing the work beyond the c<>11pletion date specified in said con-
tract. Additional provisions with regard to 11aid time of completion
and liquidated damages are set forth in the specifications, vhich pro-
visions are hereby referred to and incorporated herein by reference.
SECTION 6. Said sealed proposals or bids shall be delivered to
the Director of Purchasing Services of City on or before 3i00 o'clock
p.m. on June 12, 1985, said time being not less than ten (10) days from
the time of the first publication of said notice. Bids will be
publicly opened, examined and declared on said day and hour, and
referred to and considered by the c~~ncil at its meeting at 7:30
o'clock p.m. on July 1, 1985.
