ORIGINAL RESOLUTION NO. 6368 RESOLUTION OF THE COUNCIL OF THE C"I'TY OF PALO ALTO AP~ROVING THE .\PPLICATION FOR GRANT FUNDS UNDER THE ROBERTI-Z'BERG URBAN OPEN-SPACE AND RECREATION PROGRAM FOR PALO ALTO OOWNTOWN PARK NORTH IMPROVE- MENT PROJECT WHEREAS, the legislature of the State of Cal iforn:i.a has enacted the Roberti-Z'berg Urban Open-Space and Recreation Program, which pro- vides funds to certain political subdivisions of the State of Califor- nia for acquiring lands and for developing facilities to meet urban recreation needs1 and WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility for the administration of the program, &etting up necessary procedures governing opplication by local agencies under the program; and WHEREAS, said procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of applications prior to submissioh of said applications to the stater and WHEREAS, said applications contain a certification that the appli- caht will comply with all federal, state, and local environmental, public hea 1th, relocation, affirmative a.:: t ion, and clearinghouse re- quirements and all other appropriate codes, laws and regulations prior to the expenditure of the grant funds1 and WHEREAS, the project applied for under this program must be of a high priority and satisfy the most urgent park and recreation needs with emphasis on unmet needs in the most heavily populated area; NOW, THEREFORE, the council of the City of Palo Alto does RESOLVE as follows: SECTION ~. The Council hereby approves the filing of an applica- tion for funding under the Roberti-:t 'berg Tlrban Open-Space and Recrea- tion Program .. SECTION 2. The Council hereby certifies that it understands the general provisions of the agreement. SECTION 3. The Council hereby certifies that it has or will have sufficient funds to operate and maintain the project funded under this program. SECTION 4. The Council hereby certifies that it has or wi:.1 have available prior t~ commencement of any work on the project included in this application matching moriey from a nonstate source. , • SECTION 5. The Council hereby certifies that the project included in this application confor1rs to the recreation element of the Palo Alto Comprehensive Plan. SECTION 6. The Council hereby appoints the City Manager or his designee as agent of the City of Palo Alto to conduct all negotiations, execute and submit all documents including but not limited to applica- tions, agreements, amendments, payment requests, and so on which may be necessary for the completion of the aforementioned project. SECTION 7. The Council hereby appoints the City Attorney as legal counsel for the City with authorization to sign the certification on page 1 of the application. SECTION 8.
