RESOLUTION Of' THE COUNCIL OF THE -"crT'i Of.<' PALO ALTO
OF THE INTENTION TO AM8ND SECTION 12.16.02U OF CHAPTER
12.16 Or' TITLE 12 OF THE PALO ALTO MUNICIPAL CODE BY
ESTABLISHING UNDERGROUND UTILITY DISTRICT No. 27
CAMBRIDGE AVENUE UNDERGROUND UTILITIES CONVERSION
The Council of the City of Palo Alto does RESOLVE as follows:
SECTION 1. That in its opinion the public necessity, health and
safety, require, and that it is the intention of said council, pursuant
to Sect ion 12. 16. 040 of Chapter 12 .16 of Title 12 of the Palo Al to
Municipal Code, to amend Section 12.16.020 of said code, by ordering
the establishment of an Underground Utility District and to prohibit
the construction in and require the removal from said proposed district
of all poles and overhead lines and associated overhead structures used
or useful in supplying electric, communication or similar and
associated services.
SECTION 2. That the name of the proposed district is Underground
Utility District Number 27 of the City of Palo Alto.
SECTION 3. That the description of the area comprising said D~oposed district is a~ follows:
All land on Cambridge Avenue between Birch Street
and Park Boulevard and on Park Boulevard between
Cambridge Avenue and California, all as more
particularly described on that certain map entitled
"Underground Utility District No. 27", on file in
the office of the City ~lerk.
SECTION 4. That from and after the effective date of the
establishment of said proposed di strict, no person or ut i 1 i ty shall
erect or construct within said district any pole, overhead lines or
asaociated overhead structure used or-useful in supplying electric,
communication or similar and associated services~
SECTION 5. That within ninety (90) days from the date of the
completion and acceptance of the proposed underground facilities within
said district to be constructed by the City of Palo Al to and the
Pacific Bell Company, all poles and overhead lines and associated
structures used or useful in supplying electric, communication or
similar and associated services in said proposed distr-ict shall be
removed, and from and after said date no person or utility shall use or
maintain such facilities within said pr-oposed district. Additional
notice shall be given after said completion dat.e has been precisely
determined.
SECTIO~ 6. That NOTICE IS HEREBY GIVEN that Monday, the 6th day
of May, 1985, at the hour of 7:30 o'clock p.m., in the regular meeting
place of said City Council, Civic Center, Palo Alto, California, are
hereby fixed as the time and place when and where said council shall
hear all protests and receive evidence for and against the action
herein proposed, and when and where said counc i 1 shall cons id er and
finally determine whether the public necessity, health and safety
require the establishment of said district and the removal of poles,
ove~head wires, and associated overhead structures, and the underground
installation of wires and facilities for supplying electric,
communication and similar or associated services in the district
hereinabove described.
SECTION 7. That at said hearing, all persons interested shall be
given an opportunity to be heard. Said hearing may be continued from
time to time as determined by said council.
SECTION 8. That Jack Taylor, Chief Electrical Engineer,
Department of Utilities, City of Palo Alto, is hereby designated as the
person to answer inquiries regarding the protest proceedings to be had
herein and may be contacted during regular off ice hours at Palo Alto
Civic Center, 250 Hamilton Avenue, Palo Alto, California, 94301, or by
calling (415) 329-2126.
SECTION 9. That the Clerk of the City shall give notice of said
hearing by mailing copies of this resolution to all property owners
within said proposed district as shown on the last equalized tax roll
of the City, and to all utilities supplying electric, communication or
similar or associated services with in said proposed district, said
mailing to be cornoleted at least thirty {30) days prior to the date of
said hearing. The Clerk is further authorized to include with such
notice the statement of option provided in section 12.16.092 of the
Code.
