RESOLUTION NO. 6323
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
ESTABLISHING CRITERIA FOR UTILIZING CRIMINAL HISTORY FOR
EMPLOYMENT, LICENSING, OR CERTIFICATION PURPOSES
WHEREAS, Penal Code Sections lllOS{b) (10) and 13300(b) (10)
authorize cities, to have access to state and to local summary
criminal history information for employment, licensing, or certi-
fication purposes, and
WHEREAS, Penal Code Sections 11105(b) (10) and 13300(b) (10)
require that there be a requirement or exclusion from employment,
licensing, or certif icatin based on specific criminal conduct on
the part of the subject of the record, and
WHEREAS, Penal code Sections 11105(b) {10) and l3300(b) (10)
require tne cit}· coun...:il of a city to specifically authorize
-ccess to summary criminal history information for employment,
licensing, or certificati~n purposes, and
NOW, THEREFORE, the Counc i 1 oi the City of Palo Al to does
resolve as follows:
SECTION 1. The Director of Persornel of the City of Palo
Alto, or his designees are hereby authorized to access summary
criminal history information for employment, licensing, or certi-
fication purposes.
SECTION 2. The City of Palo Alto shall not consider a person
who has been convicted of a felony or a misdemeanor involving
moral turpitude, eligible for employment or licensing or c~rt•fi
cation, except that such conviction may be disregarded if it is
determined that mitigating circumstances exist, or that the con-
viction is not related to the employment, license, or certif ica-
tion in question.
SECTION 3. The Council finds that the adoption of this reso-
lution will have no significant environmental impact.
SECTION 4. The prov1s1ons of this resolution shall take
ef foct on the date of its passage.
