HomeMy WebLinkAboutRESO 6300·- RESOLUTION NO. 6300 RESOLUTION UF THt: COUNCIL OF' THE CITY m· PALO ALTU UETERMINING THAT PALO ALTO'S COMPR£HC:NSIVE PLAN- BAYLANDS MASTE~ PLAN IS IN COMPLIANCE WITH THE POLICIES OF PUBLIC UTILITIES CODE ~ECTION 2i670 REGARDING THE SANTA CLARA COUNTY AIRPORT WHEREAS, Public Utilities Code (PUC) Section 21676(a), which became effective on Januar.t 1, 1983, requires the Santa Clara County Airport Land Use Commission (ALUC) to make a determination as to whe- ther Palo Alto's Comprehensive Plan-Baylands Master Plan is i~ conform- ance with the ALUC plan for th.e Santa Clara County airport and vicin- ity; and WHEREAS, on August 10, 1983, the ALUC found Palo Alto's Comprehen- s .i. ve Pla1.-Baylands Master Plan to be consistent with the ALUC Plan with the exception that no policy is expressed regarding ~edication of avi- gation easements for new development approvals within the Palo Alto referral area: and WHEREAS, the City believes its Comprehensive Plan-Baylands Master Plan is consistent with tne ALUC Plan without a policy regarding dedi- cat lon of avigation easements; and WHEREAS, the City ha~ the option, pursuant to PUC Section 21676(a), to overrule the ~LUC's finding of inconsistency, if it makes specific findings that its Comprehensive Plan-Bc..ylands Master Plan is in conformance with the purposes of the Public Utilities Code regarding Airport Land use Commissions, as stated in section 21670; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Palo Al to Cornprehens i ve Plan-Bay lands Master Plan ts consistent with Santa Clara County's Airport Land Use Cornmiss ion Plan and the purposes of the state law on Airport Land Use Commissions, set forth in Public Utilities Code Section 21670 (1) to provide for the orderly development of the Santa Clara County Airport and the area sur- rounding such airport in order to prevent the creation of new noise and safety problems and (2) to protect the public health, safety and wel- fare by minimizing the public's exposure to excessive noise and safety hazards within the area in that a. The Comprehensive Plan-Baylands Master Plan has a pol icy limiting any future expansion of the airport, thereby preventing any major construc- tion in the .. inner• and "outer• safety areas sur- rounding the airport which have been adopted by t~e ALUC (Baylands Master Plan, p. 44). .. b. City zoning ordinances implementiny the Comprehensive Plan-Baylands Master Plan are consis- tent with the ALUC Plan: 1. Height limits within the ALUC juris- dictional boundary are 35 feet or. 50 feet with a possible addition of 15 feet for mechanical equip- ment or architectural ornamentation. 2. The majority of the area within the ALUC jurisdictional boundaries i3 zoned PF(D) Public Facilities (Site and Design Review}. The remaining area is either General Manufacturing, Planned Community or Limited Industrial/Research Park Combining District. Residential uses are not permitted. 3. All major development or additions within the ALUC's jurisdictional boundaries are subject to Site and Design Review, wherein special conditions addressing aircraft safety and noise could be applied. SECTION 2. The Council finds that none of the provisions of this resolution will have a sig1~ificant environmental impact. SECTIO~ 3. The Council has adopted this resolution by at least a two-thirds vote.
