HomeMy WebLinkAboutRESO 6259•' J~:SRC:cp 05/11/84 0873S O n~,....~~-.cAL Rf.SOLUTION NO. 6 2 5 9 A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, CALLING FOR SEALED PROPOSALS AND FIXING LIQUIDATED DAMAGES FOR FAILURE TO COMPLET~ THE WORK HiiHIN TIME SPECIFIED UNIVERSITY AVENUE LOT J PARKING GARAGE ASSESSMENT OIST~ICT •..;..i -•ii '1n The City Counc11 of the City of Palo Alto does RESOLVE as follows: Section 1: On May 21. 1984. th1s Council adopted Resolution No. A Resolut1on of Preliminary Determination and of Intention to Make Acqu1sit1ons and Improvements, and plans and speciflcations suitable for calling for b'ds for construction of the improvements described in sa~d resolution have been submitted for approval by this Council. Section 2: Sa1d plans and specifications for the construction of said improvements. on file in the office of the city Clerk of this C'ty, are hereby approved. Sect1on 3: Said Clerk. is hereby directed to pub11sh once a week. for ho week.s \n the Peninsula Times Tribune. a newspaper circulated 1n the Ctty of Palo Alto and to post in three pub11c places tn thh City, a notice lnvittng sealed proposals or bids for the constructior. of sa1d improvements. and referring to the plans and spec1f1cations on f1le 1n the offtce of said Clerk. the f1rst publication of which not1ce shall be at least fourteen <i4) days pr1or to the time f1xed for opening b1ds. Section 4: All proposa's or b1ds shall be accompanied by cash. a cash1er's or certtf1ed check payable to the order of the City of Palo Alto amounting to ten percent <lO'U of the btd, or by a bond tn s~id amount and payable to the City of Palo Alto s1gned by the btdder and a corporate surety or by the bidder and two suret1es who shall justify before any officer • competent .to admi n 1 s ter an oath. in doub 1 e sa 1 d amount and over and above a 1l statutory -exemptions. The amount so posted shall be forfeited to this CHy fn-: case the bidder depos itf ng the same does not. within f1 fteen < 1 S> days after written not1ce that the contract has been awarded to such bidder, enter into the contract to construct said improvements. Section 5: Pursuant to Section 1773 of the Labor Code of the State of Ca11fornh., the City of Palo Alto has obtained from the D1rector of the Department of Industrial Relat1ons tile general preva111ng rate of per d1em wages and the general preva11,ng rate for holidays and overtime work for each craft, classification, or type of workman required to execute the contract. A copy of said prevailing rate of per diem wages is on file in the principal office of the City of Palo Alto. to which reference ts hereby made for further particulars. Said prevail\ng rate of per d'em wages will be made available to any interested party upon request, and a copy thereof shall be posted at the job stte. Section 6: That 1n the event the contractor, contracting owners inc 1 uded, does not comp 1 ete the work w1th1 ri the t1 me 1i mtt spec 1 fi ed 1 n the proposed contract or with\n such further time as tMs Council shall have author I zed, the contractor or contracting owners, as the case may be. sha 11 pay to this City 11qu1dated dair1a9es in the amount of Five Hundred Dollars <$_500.00 > per calendar day for each and every day's delay in f1n1sh1ng the work beyond the comp1et1on date specif\ed In satd contract.
