AND DESCRIBING PROPOSED BOUNDARIES OF ASSESSMENT DISTRICT AND DIRECTING FILING OF BOUNDARY MAP UNIVERSITY AVENUE LOT J PARKING GARAGE ASSESSMENT DISTRICT The City Counc11 of the City of Palo Alto does RESOLVE as follows: Ser+ion 1: On May 21, 1984, this Council adopted Rs-solution No. a Resolution of Preliminary Determination and of Intention to Make Acquisttions and Improvements. in which sa1d acquisitions and improvements were referred to the Assistant Di rector of Pub 1 i c Works for the purpose of making and filing a report in writing under and pursuant to the Palo Alto Munic1pal Code; and said report has been made and f11ed and duly considered by this Counci 1: Sectign 2: Sa1d report as a whole and each part thereof. to wit: <a> the plans and spec,fications for the proposed 1mprovements; <b> the maps and descr1 pt1ons of the lands and easements to be acquired, 1f any; < c > the eng 1 neer' s est 1 mate of the Uem1 zed and total cos ts and e)(penses of said acqu1sitfons and tmprovements, and of the incidental expenses tn ccnnect1on therew1th; <d> the d\agram showing the assessment d1strlct and the boundaries and d1mens1ons of the respective subdivisions of land within said d1str1 ct; and ' \ .... (e) the assessment of the total amount of the costs and expenses of the proposed acquisitions and improvements upon the several·: subdivisions of land in said d1sttict in proportion to the estimated benefit~ to be received by said subdivisions. respectively, from 'iaid acquisitions and improvements. and of the expenses incidental thereto; are sufficient and are prel~minarily approved. Section 3: Said report shall stand as the Engineer's Report for the purpose of all subsequent proceedings herein. Palo Alto, California, be, and the same are hereby appointed and fixed as the time and place 'ifhen and where this Council will consider and finally determine whether the public interest. convenience and necessity require said acquisitions and impro'.'ements. and when and where it will consider and finally act upon said Engineer's Report. Section 5: The City Clerk shall cause notice of said hear1ng to be gtven by pub11cation once a week for two weeks in the Peninsula T1mes Tribune, a newspaper c1rculated in the C1ty of Palo Alto, and by conspicuous posting along all the open streets within said assessment district at not more than three hundred feet apart, and not less than three in all. The first pub11cation of said notice shall be made and said post1ng shall be completed at least ten <10> days bef;.Jre the date herein set for said hearing. Said notices shall be headed "Notice of Improvement" Un letters of not less than one inch tn he,ght on the posted notice> and shal 1, 1n legible characters, state and contain: the fact and date of the passage of satd Resolution of Pre1im1nary Oeterm1nat1on and of Intent1on, the flling of said report, the 2 date, hour and place set for and the purpose of the hearing on said resolutton and report" and of protests: the total estimated cost. and a brief description-: of the proposed acQuisitions and improvements; that any person interested may flle a protest in writ,ng as provided tn the Palo Alto Municipal Code~ and reference to said resolution and report for further particulars. Section 6: Said Clerk. shall also cause notice of said hearing to be mailed. postage prepaid, at least twenty days before the date herein set for said tieari ng. to a 11 persons owni r:g rea 1 property to be assessed ~hose names anci addresses appear on the last equalized assessment roll for general taxes or are known to said Cleric... Said notices s.hall be mailed to such o°"ners at their addresses as same appear on said assessment roll, or as known to said Clerk, or to both if not the same. Section 7: The proposed boundaries of satd assessment oistrict are hereby described as shown on a map thereof filed in the office of said Clerk, which tndicates by a ooundary line the extent of the territory included in the proposed assessment d1strict and ~hich shall govern for all details as to the extent of such district, reference to such map be1ng hereby made for particulars. Said map contains the name of sa1d City and a distinctive des1gnat1on 1n words or by number of the district shown thereon. Sect1on 8: Sa1d Clerk shall endorse certificates on the original and at least one copy of said map evidencing the aforesaid filing and the date and adoption of this resolut\on. and with\n ten ClO> days after adopt1on of thh resolution, and in no event later than ten ClO>days pr1or to said hearing. sha 11 f11 e a copy thereof with the County Recorder of the County of Santa Clara. 1 n wh1 ch County a 11 of such proposed assessment district 1s located.
