"' -.. ...i '-'~ ... ~ "'~ PA.LO ALTO FT. ) 1:-~0R WHEREAS, mit i•;iated Environmental Impact Assessment for the approved project at 2375 East Bayshore Frontage Road (CMR:ll8.l) requires that a right turn lane be provided at the intersection of Embarcadero Road and East Bayshore Road; and WHEREAS, this mitigation rneasu re was necessary to minimize the impact of the proposed project evaluated by said Environmental Impact Assessment on the surrounding streets and intersections; and WHEREAS, fee title to 1~166+/-square feet of property required for construction of said right turn lane is vested in the State of California, Department of Transportation; and WHEREAS, the State of California, DeparLrnent of Transportation has agreed to sell and th€• City of Palo Al to has agreed to purchase said parcel at a price of Ten Dollars ($10): and WHEREAS, the State of California, Department of Transportation requires a resolution from the City of Palo Alto indicating that the property will be used for public purposes. NOW, THEREFORE, the Council Of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Council of the City of Palo Alto does hereby agree to purchase from the 8tate of California, Department of Transportation, that portion of property described in Exhibit A, and shown on Exhibit B, which exhibits are attached hereto and incorporated herein. SECTION 2.. The land is necessary for, and shall be used to create, a right-turn lane on East ~ayshore Road. SECTION 3. The Council hereby authorizes the City Manager to execute any document. required of the Department of Transportation to effect the acquisition and to accept the Director's Deed conveying the subject parcel to the City. SECTION 4. The Council finds that the project has no significant adverse environmental impact and, therefore, no Environmental Impact Report is required.
