HomeMy WebLinkAboutRESO 6221-OLUTION NO. 6221 • ORIGINAL RESOLUTION OF THE COUNCIL OF'i'HE CITY OF PALO ALTO AMENDING UTILITY RATE SCHEDULES G-1 AND G-50 AS A RESULT OF TRACKING PG&E GAS RATE CHANGES WHEREAS, the City Council has previously adopted Resolution No. 6212, whi~h aulhotizes the City Manager to implement nondis- ctetionary adjustments to Palo Alto gas rates to teflect gas rate increases and to track Pacif 1c Gas and Electric (PG&E} retail rate schedules G-1, G-2, and G-50; and WHEREAS, effective January 1, 1984, revenue increases were granted PG&E resulting in rate changes to its retail and wholesale rate schedules; and WHEREAS, the City Manager automatically adjusted rev~nues to match these rate changes and in accordance with Re solution No. 6212 has notified this Council of his ministerial action; NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows; SECTION 1. This Council finds that the action taken by the City Manager is in accordance with the provisions of Resolution No. 6212 that the Palo Alto Gas Rate Schedules G-1 and G-50 shall substantially conform wilh those rates contained on PG&E General Service Rate Schedules G-1 r G-2, and G-50; that the effective dates are identical to the dates of the price increases; and that in all tespecls such nond1scretionary adjustments are approved. SECTION 2. This Council finds that the revenue derived from the authorized adjustments of said gas rates by the City Mana9er shall be used only for the purposes set for th in the Pa ... o Al to City Charter, Article VII, Section 2, entitled hPublic Utilities Revenue.~ The adoption of this resolution is, therefore, specifi- cally exempted under the Public Resources Code Section 21080(b){8) from the requirements of CEQA. SECTION 3. Putsuant to Section 12.20.010 of the Palo Alto Municipal Code, Schedules G-1 and G-50 of the Palo Alto Utilities Rat~s and charges are amended to read as shown on Sheet Nos. G-1-1 and G-50-1 dated January 1, 1984 attached hereto and incorporated herein. However. the City will attempt to minimize disruption by providiny adequate notice prior to ~urtailment. The City will not be liable for damages occasioned by interruption or discontinuance of service supplied under this schedule. l. No custoc.er snall be entitled to service hereunder unless ade4uate standby e4uipment and fuel are provided and are ready at all times for ifmlediate operation in the event that the supply of gas hereunder shall be discontinued in whole or in part.
