RESOLUTION NO. 6212 RESOLUTION OF THE COUNCIL OF T~U: CITY OF PALO PROVIDING AUTHORITY TO THE CITY MANAGER TO EFFECT CERTAIN CHANGES IN GAS UTILITY RATES (SCHEDULES G-1 AND G-50) AMENDING RESOLUTION 6082 WHEREAS, the California Public Utilities Commission periodi- cally hears and gtants gas rate increases to Pacific Gas & Electric Company (PG&E): and WHEREAS, said PG&E rate increases ar·e based on fluct11at ions in costs to PG&E from certain gas producing companies, tax law changes, exchange rate changes, increased operating expenses, rate of return adjustments, and similar items reflecting the financial condition of PG&E1 and WHEREAS, it is desirable for the City of Palo Alto to adjust its g~3 rates promptly upon commencemertt of an increase from PG&E in order to avoid loss of revenue. NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1 • Effective January 1 , 1984, the City Manager is hereby authorized to adjust the gas rates of the City of Palo Alto contained in Schedule G-1 and G-50 of the City of Palo Alto Utili- ties Rates and Charges to reflect wholesale gas rate increases and to track PG&E's re·~ail rate schedules G-1, G-2, and G-50; the action of the City Manager shall be nondiscretionary. This reso- lution expires December 31, 1984. The Palo Alto Gas Rate Schedules G-1 and G-50 shall substan- tially conform with those rates contained on PG&E General Service Rate Schedules G-1, G-2 and G-50 applicable to the Peninsula-San Jose geographical area. The effective date of said adjustments to Schedules G-1 and G-50 shall be the same date on which the rate increases from Pacific Gas & Electric Company become effective. bECTION 2. The City Manager shall report any change in gas rates authorized by this resolution to the City Council as soon as practicable. If the City Council approves such changes, it shall do so by resolution. SECTION 3. The Council of the City of Palo Alto finds that the revenue derived from the authorized adjustment of said gas rates by the City Manager shall be used only for: the purposes set out in the Palo Alto City Charter, Article VII, Section 2, en- titled "Public Utilities Revenue". Therefore, the adopt ion of this resolution and the future adjustments of said gas r:ates by the City Managec as authorized herein are specifically exempted from the requirements of CEQA under Public resources Code Section 21080(b) (8).
