HomeMy WebLinkAboutRESO 6190I • ORIGINAL RESOLUTION NO. 6190 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ADOPTING AMENDMENTS TO THE PALO ALTO COMPREHENSIVE PLAN TO CLARIFY CONDITIONS UNDER WHICH EXISTING RENTAL HOUSING MAY BE REPLACED BY NEW RESIDENTIAL CONDOMINIUMS WHEREAS, the Planning Commission has conducted a review and on September 28, 1983, held a properly-noticed public hearing to consider amendments to the Palo Alto Comprehensive Plan; and W~Rf.:AS, the Planning CoDlllission has recoramended the adoption of certain amendments to the Palo Alto Comprehensive Plan to clarify con- ditions under which existing rental housing may be replaced by new residential condominiums. NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The City Council finds that changed conditions and the public interest, health, safety, and welfare require amendment to the Palo Alto Comprehensive Plan as set forth in Sections 2 and 3 hereof. SECTION 2. The City Council hereby adds a new Program llA under Policy 8 of the Housing Element of the Palo Alto Comprehensive Plan to read as follows: "'Program 13A For any residential development in multiple ... family zones which causes the loss of a rental housing unit, subdivision approval (including condominiua maps) may be granted only if any one of the following circumstances is met. A. The project will result in a significant net gain to the city housing supply (defined as 100' :more units than those previously existing on the site) and comply with the city BMR program. (broadened to include, in this case, projects with less than 10 units)1 or B. The number of rental units to be provided by the project is at least equal to the number of existing rental units {defined as all units pa.st one in any project)J or c ~ Not less t.~an 20' of the uni ts provided are b&low market rate (BMR) units (mini~um. one BMR, no in-li.eu fee) J or D. Not less thant 50% of the units shall be marketed to households of middle incomes (propor- tionally distributed among households within 120% to 150% of the County median income range) ar.d shall have deed resrictions to assure continued affordability with resale. This program establishes an acceptable trade- off between the number and type of 11ew uni ts in a condominium ~ubdivision and the loss of rental units. Condition A provides only for redevelopment within existing zoning levels. The intent of this condition is to discourage demolition of rental units where there is an insignificant net gain in units.• SECTION 3. The City Council hereby adds a new paragraph into the text of Program 17 under Policy 10 of the Housing Element of the Palo Alto Comprehensive Plan to read as follows: •program 17 The requireraents of PrograH 17 may be extended to include devf:llopments of lE·ss than 10 units. This situation would occur when developers replace rental housing with new housing, and receive sub- division approval consistent with Condition A of Program 13A of the Housing Element. SSCTION '· The City Council hereby finds that the adoption of the adaendments to the Palo Alto Comprehensive Plan set forth in Sections 2 and 3 hereof will not cause any significant environmental impacts.
